Marshall man gets stayed sentence for criminal sexual conduct
MARSHALL — A Marshall man received a stayed sentence Tuesday for charges of third degree criminal sexual conduct, Lyon County court records said.
Jacob Evan Benjamin, 29, pleaded guilty to third degree criminal sexual conduct Jan. 17 in Lyon County District Court. A criminal complaint alleged that Benjamin sexually assaulted a person in Marshall in September. The complaint alleged that Benjamin had offered to give the victim a cellular phone that was at his residence, and then assaulted the victim after they had traveled to his residence.
Court records said Benjamin entered a Norgaard plea to the charges. In a Norgaard plea, a person charged with a crime pleads guilty, but does not remember what happened during the incident.
Court records said Benjamin received a stay of execution of sentence, a $500 fine and supervised probation for up to 10 years. Probation conditions for Benjamin include that he have no contact with the victim, that he complete chemical dependency treatment, and that he register as a predatory offender and complete an adult sex offender treatment program.
Additional charges of first degree criminal sexual conduct were dismissed, court records said.
