Pearcy gets probation for wrongfully obtaining assistance charges
MARSHALL — A Marshall business owner received five years of probation for charges of wrongfully obtaining medical assistance, court records said. Thomas Scott Pearcy, 55, will also need to pay more than $90,000 in restitution, court records said.
Pearcy appeared in Lyon County District Court at a sentencing hearing Tuesday, court records said. Earlier this summer, Pearcy entered an Alford plea to three counts of wrongfully obtaining assistance. In an Alford plea, a defendant does not admit guilt of a crime, but does acknowledge that there would be enough evidence for a jury to find them guilty at a trial.
A complaint filed in Lyon County in April alleged that Pearcy did not report all his income on applications for medical assistance between 2019 and 2025. It resulted in an overpayment of about $92,000 worth of medical assistance, the complaint alleged.
The complaint alleged that Pearcy told police he did not intentionally leave out income sources on his applications.
Court records said Pearcy received a stay of imposition of sentence, and five years of supervised probation. As conditions of his probation, he would need to pay $91,419 in restitution, and perform 100 hours of community service work.
An additional three counts of wrongfully obtaining assistance charges were dismissed, court records said.
