Murray County Board approves ditch repairs

SLAYTON — The Murray County Board on a 3-0 vortex approved the attorney fees needed for Judicial Ditch 3 at its bi-weekly meeting Tuesday. The cost of legal fees will be $3,542.50, attorneys Rinke Noonan company billed for participation in the appeals process.

Commissioners Lori Gunnink and Glenn Kluis abstained as they are not on the JD 3 Committee, Administrator Aurora Heard said.

The board also voted unanimously to approve the bills on four other ditches.

Bolton & Menk said it would cost $1,350 to repair County Ditch (CD) 29, to design two drop structures to replace existing drop structures that have failed.

“This invoice also includes finalizing the plans and specifications for bidding,” Bolton & Menk’s bill said.

Gislason & Hunter LLP estimated $2,324.10 for CD 22, which was also for legal feeds incurred while reviewing documents as well as research regarding feasibility standards and preliminary hearing and reviewing a memorandum from Jeffry Baegelmann in regards to a related preliminary hearing held in Slayton.

Rinke Noonan presented a bill for $4,435 covering administrative fees of $200 and CDs 11 and 22 for $1,890 and $2,345 respectively. CD 11 is a legal fee resulting from the State Highway 30 emergency repair. CD 22 is also for legal fees.

Additionally, the commissioners voted unanimously by consensus to approve Kurt Deter as ditch inspector to review the Murray County Buffer Ordinance — Section 4.5 Alternative Practices.

It was also unanimously passed to set the final acceptance hearing for the JD 8 Improvement for May 15 at 11 a.m.
