Gaylord woman convicted of child neglect violates terms of probation

Couple originally sentenced in case involving toddler consuming alcohol

GAYLORD — A 25-year-old Gaylord woman sentenced for gross misdemeanor child neglect Dec. 18, 2025, was ordered to be held without bail in the Sibley County Jail April 8.

Victoria Lavelle Noyes of Gaylord admitted to allegedly violating probation terms (by use of alcohol) at the April 8 bail hearing.

According to court documents, law enforcement responded Sept. 30, 2025 to residence on First Avenue in Gibbon for a 1-year-old child who consumed alcohol. Officers found a one-year old child and a four-year old child in the residence. Clothes, diapers and a quarter-full bottle of Bacardi were found on the floor.

The mother, Noyes, said the father, Alfred Eugene Lee, left his alcohol bottle out and the one year old got hold of it and was drinking it when she woke up.

Lee told authorities he placed the alcohol bottle on a computer stand behind the computer and did not understand how the child was able to reach it. Lee said he was sleeping and Noyes was supposed to be watching the children.

The one-year old child was transported to the hospital. Both children were placed on an emergency hold and placed out of their home as part of a CHIPS petition (child in need of protection or services) court document.

Noyes and Lee submitted to preliminary breath tests. Her blood alcohol content (BAC) was measured at .375. His BAC was .318.

The mother (Noyes) told law enforcement that she drinks daily. She wakes up, has a shot and takes a blue pill for anxiety which causes her to sleep 12 to 24 hours at a time. Then, when she wakes up, she has more shots.

Noyes said she was in detox about two weeks prior to when law enforcement visited the residence, was sober for five days, but was not sober after that.

She said when she woke up, the one year old had the alcohol bottle in his mouth, was choking on it, and was not breathing. When law enforcement arrived at the residence, the child was walking around and had no breathing issues.

Noyes and Lee both pled guilty to gross misdemeanor child neglect Dec. 18, 2025. They were sentenced to stays of adjudication, fined $225, ordered to perform sentence to service for 40 hours and placed on two years supervised probation, monitored by Sibley County Probation.

Conditions included completing comprehensive assessments within 60 days, following recommendations and complying with child protection case court orders. A Zoom settlement conference was set for 10:30 a.m. April 30.
