NOTICE OF PUBLIC HEARING

A REQUEST HAS BEEN MADE to the Lyon County Planning and

Zoning Administrator by Jonathan Olson for a Conditional Use Permit request for a new feedlot and to hear public comment to fulfill Minnesota Session Law 2000 Minn. Stat. 116.07, subd 7(l). Odor OFFSET

setback requirement is 94%. Minimum setback for a new feedlot is 1320′. The land is zoned agricultural and described as following:

W 1/2 NE 1/4 and NW 1/4 of SE 1/4 Section Twenty Eight (28) Lucas Township (T113N R40W) Lyon County, MN

The Proposed Facility to Consist of:

(New) Finishing Hogs (1,200 x.3 animal factor)= 720 Animal Units

Type of Building:

(new) Approximately 102′ x 220′ Confinement Barn with 8′ deep below the barn concrete manure pit. Office and hog load out to be located on building. Site will also include feed storage.

Manure to be applied agronomically up to two times a year.

The Total Animal Unit Capacity = 720 Animal Units

A Public Hearing on the Conditional Use Permit and Feedlot Public Comment will be held by the Lyon County Planning Commission on Tuesday, September 13, 2016 at 7:00 p.m. in the Commissioner’s Room of the Lyon County Law Enforcement Center, Marshall, Minnesota.

A REQUEST HAS BEEN MADE to the Lyon County Planning and Zoning Administrator by Ryan Vandendriessche representing Vande Ag Enterprises for a Conditional Use Permit request for a new feedlot and to hear public comment to fulfill Minnesota Session Law 2000 – Minn. Stat. 116.07, subd 7(l), Odor OFFSET setback requirement is 94%. Minimum setback for a new feedlot is 1320′. The land is zoned agricultural and described as following:

Part of the Southeast Quarter (SE1/4) of the Northeast Quarter (NE1/4) of Section Thirty (30), Clifton township (T111N R 40 W) Lyon County, MN (5 acres to be surveyed-new parcel)

The Proposed Facility to Consist of:

(new) Finishing Hogs (4800 x .3 animal factor) = 1440 Animal Units

Type of Building:

(new) Approximately 122′ x 336′ Confinement Barn with 8′ deep below the barn concrete manure pit. Office and hog load out to be

located on building. Site will also include a well and feed storage.

Manure to be applied agronomically up to two times a year.

The Total Animal Unit Capacity = 1440 Animal Units

The Conditional Use Permit will not be final until a negative declaration on the need for an EIS has been issued.

A Public Hearing on the Conditional Use Permit and Feedlot Public Comment will be held by the Lyon County Planning Commission on Tuesday, September 13, 2016, at 7:00 p.m. in the Commissioner’s Room of the Lyon County Law Enforcement Center, Marshall, Minnesota.

A VARIANCE REQUEST has been received by the Lyon County

Planning and Zoning Administrator by Jordy Beek, to construct a garage four (4) feet from the property line. The required setback from a

property line is twenty five (25) feet. This request represents a twenty one (21) feet variance. The land is zoned agricultural and is described as part of the N 1/2 SE 1/4 Section 1, Lake Marshall Township (T111N R 41W) Lyon County, MN (Address: 2855 State Highway 19, Marshall, MN)

A Public Hearing on the Variance request will be held by the Lyon County Board of Adjustment on Tuesday, September 13, 2016 at 7:00 p.m. in the Commissioner’s Room of the Lyon County Law Enforcement Center, Marshall, MN. Public will have the opportunity to comment.
