Hearing in Broadmoor Valley case moved to October

MARSHALL — A hearing in the lawsuit against the owners of the Broadmoor Valley manufactured home park in Marshall has been rescheduled to a date in October, Lyon County court records said.

Attorneys representing both parties in the lawsuit asked a judge for more time to prepare legal briefs in the case, court documents said. On Aug. 7, a judge’s order set a hearing on motions for summary judgment for October 9.

Both the Minnesota Attorney General’s Office and Broadmoor Valley owners Schierholz and Associates are seeking a judge’s ruling in the lawsuit, which was filed in 2021. The Attorney General’s Office alleged that Schierholz and Associates had failed to maintain the streets and mobile home park to state standards, that the owners retaliated against residents, and that residents were charged unlawfully high fees for late rent payments.

In late July, the Attorney General’s Office filed court papers asking for a judgment in the case. Court documents said the state is seeking a total of $3.87 million in civil penalties against Schierholz and Associates, as well as a total of about $13,970 in restitution to residents for unlawful fees. The state is also asking for the court to require a variety of repairs and updates be done at Broadmoor Valley.

Attorneys for Schierholz and Associates also filed documents asking for the court to dismiss the lawsuit.
