Balaton man sentenced for criminal vehicular operation

MARSHALL — A Balaton man was sentenced Tuesday for criminal vehicular operation in connection with an April 2022 crash in Lyon County.

Trace Thomas Botsford, 29, was sentenced to 180 days of jail time on a staggered schedule, court records said.

A criminal complaint alleged Botsford was driving a vehicle involved in a rollover south of Lyon County Road 10 on April 2. Two passengers in the vehicle were injured in the crash. The complaint said Botsford had a blood alcohol concentration of about 0.1. Minnesota’s legal limit is 0.08.

At Tuesday’s hearing, Botsford was sentenced for charges of criminal vehicular operation. Botsford received a stay of imposition of sentence, a $500 fine, and four years of supervised probation. Conditions of Botsford’s probation included serving 180 days in jail on a staggered sentence. Court records said he would serve his sentence in four segments of 45 days. The first segment would be served this year, and Botsford would need to report for the remaining three segments by set dates in 2024, 2025, and 2026. Court records said Botsford could request a waiver for the second, third and fourth jail segments.

Additional charges of criminal vehicular operation, criminal vehicular injury, and fourth degree driving while impaired were dismissed.
