DULUTH, Minn. (AP) — A prosecutor says two northern Minnesota deputies won’t be charged in the death of a motorcyclist who fired at one of the deputies after a chase in May.

St. Louis County Attorney Mark Rubin said Wednesday that Deputies Jason Kuhnly and Troy Fralich acted in self-defense and were justified in using deadly force.

Authorities say 37-year-old Timothy Majchrzak fled from police in Hermantown on a motorcycle. Majchrzak refused orders to drop a handgun and fired at Kuhnly, who then shot and fatally wounded the suspect.

When Fralich saw Majchrzak raise his gun again, the deputy drove into him with his squad car, knocking him to the ground.

The suspect died of multiple gunshot wounds. A gun was found near him. The state Bureau of Criminal Apprehension investigated.
