MARSHALL -- Another Minnesota company - this time from Marshall - has sued Old National Bank, alleging the bank failed to notify them of fraudulent activity in their accounts.
According to documents filed Oct. 2 in U.S. District Court, Midwest Ag Enterprises, Inc., of Marshall, and two related companies claim criminals gained access to their bank accounts and stole about $549,000 through fraudulent transfers this summer. The companies' complaint claims that Old National Bank did not detect the transactions or notify the businesses.
The complaint claims that when Midwest Ag Enterprises and related companies banked with Bremer Bank, they had an agreement to implement safety protocols including a mandatory call-back on any wire transfer of more than $25,000. These safety protocols did not survive the acquisition of Bremer by Old National Bank in 2025, the complaint claims.
Court documents say Midwest Ag Enterprises and the two related companies are seeking damages including refunds of unauthorized payments, and are asking for a jury trial.
The complaint filed by Midwest Ag Enterprises also claimed that other area customers of Old National also lost money to bank "spoofing" scams in 2025, shortly after the merger with Bremer.
In August, Marshall Screw Products, a St. Anthony-based company, sued Old National Bank in Ramsey County Civil Court. The lawsuit was sent to federal court in September.
The civil complaint filed in Ramsey County claimed Marshall Screw Products had more than 50 fraudulent debits from its account totaling more than $1 million, even though the company was paying for an Old National service that was supposed to protect against unauthorized electronic transactions.
The civil complaint claimed Marshall Screw Products only recovered about $77,000 from the fraudulent transactions, and Old National refused to reimburse the remaining $1.02 million lost.
According to documents filed in Minnesota District Court, Old National Bank has moved to send Marshall Screw Products' complaint to arbitration, instead of continuing with the court case. A hearing is scheduled for Dec. 18, Minnesota District Court records said.
