Lawsuit claims bank failed to stop over $1 million in fraud

A Minnesota-based company has sued Old National Bank claiming that the bank failed to protect the business's checking account from more than $1 million in fraudulent transactions, Ramsey County court documents said.

Marshall Screw Products, a St. Anthony company doing business as Marshall Manufacturing, filed a civil suit against Old National Bank Foundation, Inc., in Ramsey County Civil Court in August. The civil complaint said claims against Old National included negligence and misrepresentation of its services.

The complaint said Marshall Screw Products was paying for an Old National Bank product that would protect their account from unauthorized electronic transactions. However, the complaint claims that in November 2025, there were 55 fraudulent transactions in the company's checking account, resulting in losses of over $1 million.

Court documents said Marshall Screw Products had banked with Bremer Bank for more than 25 years before Old National Bank bought Bremer in 2025.

Marshall is one of the Minnesota communities with a Bremer Bank location that has transitioned into an Old National Bank location.

The civil complaint claimed that the bank reported a suspicious transaction to Marshall Screw Products in August 2025. Old National said that, instead of closing the compromised account, the business could enable a subscription service called ACH Positive Pay for added protection.

Despite the company paying for ACH Positive Pay, Marshall Screw Products had 55 fraudulent debits from its account over a period of a couple of days in November 2025, the civil complaint said. The fraudulent debits totaled $1.1 million, leaving the account with a negative $700,000 balance.

The civil complaint claimed Marshall Screw Products only recovered about $77,000 from the fraudulent transactions, and Old National refused to reimburse the remaining $1.02 million lost.

Marshall Screw Products is seeking damages and attorney's fees from Old National Bank Foundation, the complaint said.

Marshall Screw Products filed its civil complaint in Ramsey County Civil Court on Aug. 25. A summons said the Old National Bank Foundation had 21 days to file a written response. So far, no response has been filed, according to online court records.
