MARSHALL -- The city of Tracy and Southwest Health and Human Services are asking for the Minnesota Attorney General's help in determining the future of a manufactured home park in Tracy.
During Tuesday's Lyon County Board meeting, commissioners voted to sign a letter seeking assistance in taking enforcement actions against the Cedar Lane Manufactured Home Park in Tracy. The letter to the Attorney General said Cedar Lane has been operating without a valid license since Nov. 24.
SWHHS revoked the park's license for failing to either build a storm shelter for residents, or to get an approved emergency plan from the city of Tracy, the letter said. Cedar Lane has also been noncompliant with plumbing and sewage disposal requirements, the letter said.
The letter asked for the attorney general's help to take action against the violations, up to the closure of Cedar Lane and relocation of residents.
"The Tracy city attorney Matt Gross and Bill Toulouse, the Southwest Health and Human Services attorney, have all agreed that we're at the point that this should be the attorney general's area to take care of," Lyon County Board chairman Todd Draper told county board members Tuesday.
"I assume it's not like they had a fallout shelter and they took it down. They've never had one, correct?" asked Commissioner Paul Graupmann.
Draper said Cedar Lane did not have a storm shelter for residents. In the past, the park had worked with the city of Tracy to use the Veterans Memorial Center as a storm shelter, but the building wasn't easily accessible 24 hours a day, he said.
Commissioners also said there were ongoing questions as to whether the Cedar Lane property had officially changed ownership recently.
Draper said the city was concerned for the residents of Cedar Lane.
"They've been to city of Tracy board meetings and asked for help, because that's their home," he said.
The letter drafted by Tracy city and SWHHS attorneys asked the Minnesota Attorney General's Office to bring enforcement action against Cedar Lane for operating a mobile home park without a license. The letter included in the county board agenda packet asked that the enforcement be "up to the closure and mandated relocation of the Cedar Lane residents."
Commissioners voted in favor of a motion authorizing Draper to sign the letter. At the same time, some commissioners said they weren't sure how fast of a response to expect from the Attorney General's Office.
"I don't think you're going to see a quick answer on this," said Commissioner Rick Anderson.
