MARSHALL -- The Marshall City Council voted this week to approve a development agreement for residential construction near Canoga Circle. The agreement would allow a local developer to build townhomes in an area of Marshall near businesses like the Canoga Park Childcare center, the Super 8 hotel and the Hitching Post restaurant.
"Back in March, we approved a plat for this subdivision along the Canoga pond," said Marshall Public Works Director Jason Anderson. Marshall developer Greg Taylor was seeking to build two-unit townhomes on an area of land he owned, stretching back from Canoga Circle. Canoga Circle is located off of Canoga Park Drive, in the southern part of Marshall. The planned development would affect six lots.
However, Anderson said, the construction would not be possible without an access road and water and sewer infrastructure.
"We've worked with City Attorney Pam Whitmore and her team to develop a developer's agreement that outlines the relationship between the parties," he said.
Under the development agreement, the access drive for the townhomes will be private, and the water and sewer infrastructure serving the townhomes will become publicly owned and operated once construction is complete.
"As part of the agreement, we would also be securing a stormwater maintenance agreement over the existing pond," Anderson said.
Anderson said there will still be some minor adjustments that would need to be made in the agreement. For example, the developer was proposing to install the road and utility infrastructure in two phases.
"I'll be working with the city attorney to make some adjustments to the agreement to reflect that as well," Anderson said. "We would like to move forward. I think he's ready to get moving on this project, and this is one of the final approvals in that process."
