Marshall man challenges search warrant in drug case
MARSHALL — A Marshall man facing drug charges in Lyon County is challenging a search warrant in his case, court records said.
An affidavit filed in Lyon County District Court said Dante Maurice Stidman, 47, believed a law enforcement officer intentionally left out information when he asked a judge for a search warrant for Stidman’s apartment and vehicle. At a hearing Tuesday, a district court judge gave attorneys in the case time to file written arguments on whether the search warrant was valid.
In January, Stidman was charged in Lyon County District Court with first degree and third degree drug possession. A complaint alleges that law enforcement executed a search at Stidman’s apartment on Jan. 14. The complaint alleges that Marshall Police found a crystal substance that appeared consistent with methamphetamine in the bathroom toilet, and that the water from the toilet field tested positive for meth.
On Feb. 23, attorneys for Stidman filed a motion to invalidate the search warrant for Stidman’s apartment and vehicle, and a motion to dismiss the charges. An affidavit said Stidman believed law enforcement’s search warrant application left out information like a swab from his vehicle door handles that did not test positive for drugs.
The motion to dismiss the charges against Stidman claimed that in addition to challenges to the search warrants, there was not probable cause for the drug charges.
At Tuesday’s hearing, District Court Judge Michelle Dietrich said she wasn’t able to hear attorneys’ oral arguments on the probable cause issues due to time constraints. Instead, she gave attorneys a timeline to submit written arguments. Attorneys for Stidman had until March 10 to submit written arguments, and prosecuting attorneys had until March 17 to submit their written arguments.
