Man charged in Balaton hit-and-run pleads not guilty
MARSHALL — A Balaton man charged in connection with a hit-and-run incident in December has pleaded not guilty to charges of assault and criminal vehicular operation, district court records said.
Carlos Eduardo Rodriguez Rivera, 30, appeared in Lyon County District Court at a hearing Tuesday. Rivera is charged with second degree assault with a dangerous weapon, criminal vehicular operation and fifth degree assault.
A criminal complaint alleges that on the night of December 20, Rivera struck a pedestrian outside the Balaton Liquor Store with a pickup truck, and then drove away from the scene. The pedestrian had minor injuries in the incident, the complaint alleged. The complaint alleged that Rivera had been drinking at the Liquor Store prior to the incident, and had also allegedly taken a swing at the pedestrian outside the store.
At Tuesday’s hearing, an attorney for Rivera entered not guilty pleas on Rivera’s behalf, and asked for a jury trial, court records said. A pre-trial date was set for June 9, and trial dates were set for June 17 and 18.
A settlement conference was also set for April 28, court records said.
