Board upholds Marshall man’s release from ICE custody

A Marshall man who was detained by ICE earlier this year will not be going back into custody.

This week, the federal Board of Immigration Appeals dismissed the Trump administration’s appeal of an immigration judge’s order releasing Aditya Harsono, MPR News reported.

Harsono, 35, was released from Immigration and Customs Enforcement custody in May. An immigration judge ruled that Harsono’s First Amendment rights had been violated, and ordered his release on a $5,000 bond.

The Trump administration challenged the judge’s order. But the Board of Immigration Appeals ruled the judge was within her discretion to order Harsono’s release, MPR News reported.

The Board of Immigration Appeals is the U.S.’s highest administrative body for interpreting immigration laws. According to the board’s website, the BIA hears appeals of decisions by immigration judges and district directors of the Department of Homeland Security.

Harsono came to the U.S. from Indonesia in 2015 to study at Southwest Minnesota State University. He was arrested by ICE at his workplace in Marshall on March 27, allegedly for overstaying his visa.

Harsono later learned that his visa had been revoked a few days before, without his knowledge.

After being released from ICE custody, Harsono was reunited with his wife and daughter in Marshall, MPR News reported. He is applying for a green card, and his application is progressing, MPR News reported.
