Contractor lawsuit against Broadmoor Valley owners settled
MARSHALL — A Lyon County District Court judge has awarded a contractor more than $32,000 in a lawsuit against the owners of the Broadmoor Valley mobile home park, court records said. A civil complaint claimed that Broadmoor Valley owners Schierholz and Associates failed to pay an invoice for work the contractor completed at the park in 2023 and 2024.
Court documents filed Tuesday said judge Tricia Zimmer entered a judgement in a lawsuit brought against Broadmoor Valley owners Schierholz and Associates by Towne & Country Excavating, LLC.
The lawsuit claimed Towne & Country entered into a contract with Schierholz and Associates in 2023 for improvements at the mobile home park. The lawsuit claimed Schierholz and Associates broke the contract, by refusing to pay an invoice of $32,217.94 for the completed work.
Documents filed Tuesday in Lyon County District Court said the two sides had reached an agreement for a judgment to be entered in Towne & Country’s favor, in the amount of $32,217.94. A judgment awarding that amount was also entered, court records said.
Schierholz and Associates have been the focus of three other lawsuits in Lyon County District Court. The Minnesota Attorney General’s Office sued the Broadmoor owners in 2021, alleging that the park was not kept up to state standards, and that Schierholz charged unlawfully high fees for late rent payments. The lawsuit went to trial in January, and a jury ruled mainly in favor of Schierholz and Associates.
Two other lawsuits are also ongoing. The city of Marshall sued Schierholz and Associates over the installation of a locked gate blocking one of the mobile home park’s only two entrances. The Minnesota Housing Finance Agency also sued Schierholz and Associates after Schierholz announced they intended to close Broadmoor Valley. Minnesota Housing’s lawsuit alleges closing the park would break the conditions of a grant agreement that awarded Schierholz and Associates $500,000.
