Tracy teacher pleads guilty to disorderly conduct

Haberman receives probation for incident involving student

MARSHALL -- A Tracy teacher accused of pushing a student up against a wall pleaded guilty to disorderly conduct charges on Tuesday, Lyon County court records said. Richard William Haberman, 54, received a stayed sentence and up to one year of probation, court records said.

A criminal complaint filed in Lyon County District Court alleged that in March, Haberman grabbed a student and pushed him up against the wall during gym class at Tracy Elementary School. The student showed law enforcement he had a bruise and a scratch on his arm as a result of the incident, the complaint said.

Haberman had been suspended without pay for two days after the incident with the student, Tracy Superintendent Chad Anderson said.

In a Zoom hearing held Tuesday, Haberman's attorney said a resolution had been reached in the case. As part of the agreement, Haberman pleaded guilty to disorderly conduct. Additional charges of malicious punishment of a child and fifth degree assault were dismissed, court records said.

Haberman apologized for his actions in the incident, court records said.

Haberman received a stayed sentence of 90 days in jail, and up to a year of probation. Haberman was also required to complete an anger management course, have no contact with the student in the incident, and pay a $300 fine, court records said.
