Marshall City Council OKS new plat for Dollar General
MARSHALL — The city of Marshall will be moving forward with a new plat for the property where a new Dollar General store has been built. After a public hearing Tuesday night, Marshall City Council members approved the plat.
The new plat would correct errors with the legal description of what is now the Dollar General property on East College Drive, said Marshall Marshall Public Works Director Jason Anderson.
“Essentially what occurred here is the developer purchased two lots to construct their Dollar General store. It was determined a couple months ago, when they went to the county to combine the lots into one, that there was an issue with the property description,” Anderson said.
Under the existing legal descriptions, the two lots actually overlapped slightly. The county would not combine the two lots, Anderson said.
Anderson said the city worked together with the developer to plat the property and properly combine the lots.
“In general, city staff has no issues or concerns with the plat as presented. We would recommend to approve it,” Anderson said.
“Platting process requires that anybody who has an interest in the property has to sign off on it. That includes mortgage companies,” said Marshall City Attorney Dennis Simpson. “There is a mortgage company from Arkansas that has the first mortgage against the property. They can either sign the plat, or sign a consent to plat.”
Simpson said the consent to plat has been sent to the mortgage company for a signature.
No members of the public spoke at the hearing. Afterward, the council voted in favor of a motion to approve the new plat, contingent on approval from the mortgage company.
