Marshall man indicted for producing child pornography
Wife loses license to operate home day care business
MARSHALL — A Marshall man has been indicted for producing child pornography, leading to his wife losing her child care license.
Chad T. VanLerberghe, 44 of Marshall was indicted Nov. 24, 2020 and appeared in federal court Wednesday, Dec. 2, in Minneapolis on eight counts of producing, attempting to produce, or distributing child pornography.
The first four counts were for production and attempted production of child pornography. VanLeberghe stands accused of taking four sexually explicit photos of two girls and an infant between Nov. 15, 2019, and Feb. 14.
The last four counts were for the distribution of child pornography. According to court documents, VanLeberghe is being charged with knowingly distributing the photos.
VanLeberghe pleaded not guilty, but the court ordered him detained pending trial. His next court appearance is on Jan. 19, 2021.
The prosecution moved to have him detained on the grounds no release conditions or combination of conditions could assure the safety of the community. In addition to the risk of danger, VanLerberghe was viewed as a flight risk because the charges against him carry a lengthy sentence if convicted.
VanLerberghe’s wife, Lupita VanLerberghe operated a home day care at the time of the offenses. In February 2020, the state Department of Human Services immediately suspended the home daycare license for Lupita Vanlerberghe. The charges against her husband were the reason for the suspension.
The license was revoked two months later on May 20, after state regulators determine household members were responsible for maltreatment of children.
The VanLerberghes are the parents of five children, ranging from 1 to 13. The daycare was licensed to care for 12 children.
Court documents did not indicate if any children from the daycare were victims in the charges filed.
Lupita VanLerberghe was previously cited by the state for failing to take necessary childcare training and failing to have someone on-site trained in first aid and CPR.
