S.D. shooting suspects charged with murder after victim dies, appear in Lyon County court

MARSHALL – The two suspects arrested in Marshall on Friday for their involvement in a Sioux Falls, South Dakota, shooting are now facing murder charges after the victim, Anthony Lee Gabriel, 18, died Sunday afternoon at the Sanford Medical Center of a gunshot wound to the head, Sioux Falls Police said.

During a Monday morning news briefing, Sioux Falls Police Department Lt. Matt Burns said the suspects, Robert Edward Montes, 19, and Connor Bryon Hanson, 17, had their charges updated from aggravated assault and attempted murder to first degree murder, second degree murder and first degree manslaughter.

The two suspects were held in the Lyon County Law Enforcement Center over the weekend and appeared in Lyon County District Court on Monday morning as part of their extradition process. They were transported to Minnehaha County on Friday afternoon.

Montes appeared in court without an attorney and waived his right to an extradition hearing, asking to “be sent back to South Dakota.” Hanson appeared with an attorney and also waived his right to an extradition hearing, “seeking return to South Dakota to challenge the charges,” his attorney said.

During Monday’s news briefing, Burns said the investigation into the shooting is ongoing, including which of the suspects fired multiple shots and what ties and connections they have to Marshall. Sioux Falls Police are also still looking for a number of evidence items, including a 9mm handgun used in the shooting, Burns said.

He added that he was not aware of any gang affiliation, drugs or alcohol in the incident, and stated that there is no danger to the public as the persons responsible are in custody.

Montes and Hanson had warrants issued for their arrest after a shooting incident occurred near the Empire Mall in Sioux Falls on Thursday night that left Gabriel with life-threatening injuries. In a press conference video posted by the Argus Leader on Friday, Sioux Falls Police spokesman Sam Clemens said Gabriel was shot in the head as he was driving on Louise Avenue following an argument that occurred near 6th Street and Cliff Avenue. Clemens said the cars were “essentially chasing each other around Sioux Falls.”

The suspects’ vehicle was in front of the victim’s vehicle when the shooting began, Clemens said, and a 20-year-old woman and her five-month-old baby were also in the car. After the Gabriel was shot, the woman was able to lean over and get the car stopped and call police, Clemens said.

KSFY news reported Monday that, according to a detective’s affidavit, Gabriel and the two suspects had a history of “bad blood” over relationship issues with girlfriends, and that the five-month-old girl who was in Gabriel’s car at the time of the shooting was the son of Gabriel’s girlfriend and Hanson.

On Friday morning, Sioux Falls Police asked for the public’s help in finding the suspects. The two teens were arrested Friday night in Marshall after police received information from a tipster that the two were in town. Marshall Police said they received information that Montes and Hanson may have been dropped off at an apartment complex on Birch Street but later found the pair walking on South Bruce Street near Avera Marshall Regional Medical Center where they were arrested without incident.
