MARSHALL – Paul Charles Demings, 21, of Marshall, pleaded guilty in Lyon County District Court April 14 to charges of fourth degree driving while impaired, court records said. A complaint alleges Demings drove while impaired in Marshall on Oct. 28. Demings pleaded guilty to the charges via an Alford plea, court records said. In an Alford plea, a defendant maintains that he is innocent of the charges against him, but acknowledges that there would be enough evidence for a jury to convict him. Demings received a stayed sentence of 90 days in jail, a $600 fine, and one year of probation, with conditions including abstain from alcohol and drugs, and abide by laws. Additional charges of refusal to take a chemical test were dismissed.

MARSHALL – Sandra Isabel Cervantes, 36, of Cottonwood, pleaded guilty in Lyon County District Court April 14 to charges of second degree driving while impaired, court records said. Cervantes drove with an alcohol level of .21 in Marshall on Feb. 3, court records said. Cervantes was sentenced to one year in jail with 275 days stayed, pay a $1,000 fine, and three years probation with conditions including serve 90 days in jail, obtain a chemical use assessment and abide by laws. Additional charges of second degree driving while impaired were dismissed.

MARSHALL – Gabriel Timothy Swift, 43, of Marshall, pleaded guilty in Lyon County District Court April 14 to charges of second degree driving while impaired, court records said. Swift drove with an alcohol level of .2 in Marshall on Nov. 21, court records said. Swift was sentenced to one year in jail with 275 days stayed, pay a $1,000 fine, and two years probation with conditions including serve 90 days in jail, abstain from alcohol and drugs, and be subject to random testing. Additional charges of second degree driving while impaired, failure to provide insurance, and stop sign violation were dismissed.

MARSHALL – Michael Patrick Janachovsky, 57, of Lucan, pleaded guilty in Lyon County District Court April 14 to charges of third degree driving while impaired, court records said. Janachovsky drove with an alcohol level of .21 in Lyon County on Dec. 14, court records said. Janachovsky was sentenced to one year in jail with 355 days stayed, pay a $900 fine, and two years probation with conditions including serve 10 days in jail, abstain from alcohol and drugs, and be subject to random testing. Additional charges of third degree driving while impaired were dismissed.

MARSHALL – Mathew Paul Crow, 19, of Bird Island, appeared in Lyon County District Court April 15 on charges of carrying a firearm without a permit and fourth degree criminal property damage – liability for crimes of another. A complaint alleges Crow carried a handgun in a motor vehicle in Lyon County on Feb. 6-7, and that Crow or an accomplice shot and damaged a sign in Garvin Park. A hearing was set for April 28. Bail for Crow was set at $6,000 without conditions, or release with conditions including appear in court and abide by laws.

MARSHALL – Dustin Eugene Clapp, 29, of Minneota, appeared in Lyon County District Court April 21 on charges of driving after cancellation – inimical to public safety, having no insurance, and tampering with a motor vehicle. A complaint alleges Clapp entered another person’s vehicle without consent, and drove with a cancelled license in Lyon County on Jan. 17. A hearing was set for May 19.

MARSHALL – Arnold Camiel Thooft, 61, of Arco, appeared in Lyon County District Court April 21 on charges of issuing a dishonored check. A complaint alleges Thooft issued a check from an account with insufficient funds in Tracy on Nov. 29. A hearing was set for May 19.

Courts

MARSHALL – Allen Lee Watts, 32, of Russell, appeared in Lyon County District Court March 31 on charges of second degree driving while impaired – refusal to test, and driving after suspension. A complaint alleges Watts refused to take a chemical test in Marshall on March 6. A hearing was set for April 28.

MARSHALL – Krystal Anne Marie Martin, 29, of Marshall, appeared in Lyon County District Court March 31 on charges of first degree controlled substance crime – liability for crimes of another, second degree controlled substance crime – liability for crimes of another, child endangerment – liability for crimes of another, possession of drug paraphernalia – liability for crimes of another, and two counts of methamphetamine-related crime involving children – liability for crimes of another. A complaint alleges Martin or an accomplice possessed methamphetamines in a home where children were present in Marshall on Nov. 21. A hearing was continued to April 14.

MARSHALL – Kasey Roy Westberg, 28, of Marshall, appeared in Lyon County District Court March 31 on charges of first degree controlled substance crime – liability for crimes of another, second degree controlled substance crime – liability for crimes of another, child endangerment – liability for crimes of another, possession of drug paraphernalia – liability for crimes of another, and two counts of methamphetamine-related crime involving children – liability for crimes of another. A complaint alleges Westberg or an accomplice possessed methamphetamines in a home where children were present in Marshall on Nov. 21. A hearing was continued to April 14.

MARSHALL – Abdifatah Hassan Ahmed, 23, of Marshall, was sentenced in Lyon County District Court March 31 for charges of terroristic threat, first degree criminal property damage and fourth degree assault. Ahmed assaulted a man and damaged a car in Marshall on Dec. 20, court records said. Ahmed received a stayed sentence of 18 months in prison, a $500 fine, and five years probation with conditions including serve 270 days in jail, complete an anger management course, and have no contact with the victims. Additional charges of fourth degree assault and fifth degree assault were dismissed.

MARSHALL – Nicholas John Samson, 25, of Slayton, appeared in Lyon County District Court March 31 on charges of theft and receiving stolen property. A complaint alleges Samson acted as a lookout during a theft at a Marshall business on Oct. 3. A hearing was continued to April 14.

MARSHALL – Curt Earnest Cermak, 33, of Tracy, appeared in Lyon County District Court March 31 on charges of malicious punishment of a child and domestic assault. A complaint alleges Cermak maliciously punished a child in Tracy on Jan. 9. The court found probable cause for the charges, and a hearing was set for April 28.

MARSHALL – Micah Lee Ward, 20, of Minneapolis, appeared in Lyon County District Court March 31 on charges of domestic assault by strangulation, harassment, domestic assault, violation of a domestic assault no-contact order, and giving a false name and date of birth. A complaint alleges Ward assaulted a woman in Marshall on Jan. 22. A hearing was continued to April 14.

MARSHALL – Daniel Lee Johnson, 23, of Ruthton, pleaded guilty in Lyon County District Court March 31 to charges of third degree driving while impaired, court records said. Johnson drove while impaired in Marshall on Feb. 1, court records said. Johnson was sentenced to one year in jail with 335 days stayed, pay a $700 fine, and two years probation with conditions including serve 30 days in jail, obtain a chemical use assessment and abide by laws. Additional charges of third degree driving while impaired were dismissed.

MARSHALL – Scott Allen Hartson, 33, of Marshall, pleaded guilty in Lyon County District Court March 31 to charges of theft, court records said. Hartson stole more than $900 from a Marshall business between Dec. 1 and Jan. 27, court records said. Hartson received a stayed sentence of one year in jail, a $400 fine, and two years probation with conditions including complete 100 hours of community service work, pay $967.64 in restitution, and do not enter the business while on probation.

MARSHALL – Larry Alan Schreier, 32, of Tracy, pleaded guilty in Lyon County District Court March 31 to charges of theft – liability for crimes of another, court records said. Schreier or an accomplice stole more than $2,000 worth of merchandise from a Marshall business on Feb. 6, court records said. Schreier received a stay of imposition of sentence, a $500 fine, and five years probation with conditions including serve 90 days in jail, obtain a chemical use assessment, and abstain from alcohol and drugs. Additional charges of possession of stolen property – liability for crimes of another were dismissed.

MARSHALL – Shelby Eugene Gronewold, 39, of Tracy, pleaded guilty in Lyon County District Court March 31 to charges of third degree driving while impaired, court records said. Gronewold drove while impaired in Tracy on Feb. 18, court records said. A sentencing hearing was set for April 28.

MARSHALL – Forrestt Duwayne Labatte, 26, of Granite Falls, pleaded guilty in Lyon County District Court March 31 to charges of second degree driving while impaired – refusal to test, court records said. Labatte refused to take a chemical test in Marshall on Feb. 7, court records said. Labatte was sentenced to one year in jail with 277 days stayed, pay a $1,000 fine, and two years probation with conditions including serve 90 days in jail, obtain a chemical use assessment and be subject to random testing. Additional charges of driving after suspension were dismissed.

MARSHALL – Juan Carlos Esparza Campos, 48, of Marshall, appeared in Lyon County District Court March 31 on charges of second degree driving while impaired – refusal to test. A complaint alleges Campos drove while impaired in Marshall on Feb. 10. A hearing was continued to April 14.

MARSHALL – Carl Thomas Anderson, 39, of Marshall, was sentenced in Lyon County District Court March 31 for charges of violating a harassment restraining order. On March 12, a jury found Anderson guilty of violating a harassment restraining order in Marshall in October, court records said. Anderson received a stayed sentence of 15 months in prison, a $500 fine, and five years probation with conditions including serve 90 days in jail, have no contact with the victim, and complete 40 hours of Sentenced to Service.

MARSHALL – Michael Daniel Halquist, 23, of Marshall, appeared in Lyon County District Court March 31 on charges of third degree driving while impaired, and ignition interlock violation. A complaint alleges Halquist drove while impaired in a vehicle without an ignition interlock in Lyon County on Aug. 22. A trial date was set for April 8.

MARSHALL – Demarious Marquis Lewis, 22, of Granite Falls, appeared in Lyon County District Court April 1 on charges of fleeing a peace officer in a motor vehicle, fleeing a peace officer, and having no Minnesota driver’s license. A complaint alleges Lewis fled a traffic stop in Marshall on March 31. A hearing was set for April 14. Bail for Lewis was set at $10,000 without conditions or $2,000 with conditions including appear in court, do not leave Minnesota, and abide by laws.
