MARSHALL – Phillip Michael Smith, 27, of Marshall, pleaded innocent in Lyon County District Court Aug. 5 to charges of check forgery – liability for crimes of another, and theft. A complaint alleges Smith or an accomplice stole blank checks and wrote a false check in Marshall on Jan. 25. A trial date was set for Oct. 22-23, with a date certain of Feb. 26-27. A pre-trial hearing was set for Oct. 14.

MARSHALL – Jeffrey Allan Miller, 48, of Garvin, pleaded innocent in Lyon County District Court Aug. 5 to two counts of third degree driving while impaired charges. A complaint alleges Miller drove while impaired in Lyon County on May 24. A trial date was set for Sept. 24, and a pre-trial hearing was set for Sept. 9.

MARSHALL – Richard Alan McCracken, 38, of Marshall, pleaded guilty in Lyon County District Court Aug. 5 to charges of fleeing a peace officer, court records said. McCracken fled a peace officer while being arrested on a warrant in Marshall on July 3, court records said. McCracken was sentenced to 90 days in jail with credit for 34 days already served, and to pay a $100 fine. Additional charges of escaping custody and obstructing legal process were dismissed.

MARSHALL – David Victor Hoffbeck, 59, of Marshall, pleaded guilty in Lyon County District Court Aug. 5 to charges of second degree driving while impaired – refusal to test, court records said. Hoffbeck drove while impaired in Lyon County on March 4, court records said. Hoffbeck was sentenced to 303 days in jail, with credit for 130 days already served. Additional charges of driving after revocation and failure to provide proof of insurance were dismissed.
