Courts for Feb. 8

MARSHALL – Jeffrey Scott Ellingson, 48, of Marshall, appeared in Lyon County District Court Feb. 4 on charges of third degree driving while impaired – refusal to test and fourth degree driving while impaired. A complaint alleges Ellingson drove while impaired in Marshall on Nov. 9. The court found probable cause for the charges. A plea hearing was set for Feb. 18.

MARSHALL – Paul Charles Demmings, 20, of Marshall, appeared in Lyon County District Court Feb. 4 on two counts of theft charges. A complaint alleges Demmings stole a parking pass in Marshall on Sept. 12 and a parking boot in October. A hearing was set for Feb. 18.

MARSHALL – Linda Marie Hiedeman, 51, of Truman, appeared in Lyon County District Court Feb. 4 on charges of third degree controlled substance crime. A complaint alleges Hiedeman sold methamphetamines in Marshall in 2012. The court found probable cause for the charges. A hearing was set for March 4.

MARSHALL – Connie Marie Gerads, 28, of Minneota, appeared in Lyon County District Court Feb. 4 on charges of first degree controlled substance crime, third degree controlled substance crime and fifth degree controlled substance crime. A complaint alleges Gerads sold methamphetamines and marijuana in Marshall on separate occasions between Nov. 16, 2012, and Feb. 10, 2013. A hearing was set for March 4. Bail was set at $75,000 without conditions or $50,000 cash or bond with conditions including appear in court, abstain from alcohol and drugs and be subject to drug testing. The court ordered Probation to complete a bail study.

MARSHALL – Timothy John Cox, 50, of Marshall, appeared in Lyon County District Court Feb. 4 on charges of second degree driving while impaired. A complaint alleges Cox drove with an alcohol level of .22 in Marshall on Jan. 18. A hearing was set for March 4.

MARSHALL – Nathaniel Louis Shipley, 23, of St. Leo, appeared in Lyon County District Court Feb. 4 on two counts of first degree burglary, criminal property damage and trespassing charges. A complaint alleges Shipley broke into an apartment and assaulted a man in Marshall on Jan. 17. A hearing was set for Feb. 18.

MARSHALL – Kaitlyn Grace Rabaey, 22, of Marshall, appeared in Lyon County District Court Feb. 4 on two counts of third degree driving while impaired charges. A complaint alleges Rabaey drove with an alcohol level of .2 in Marshall on Jan. 18. A hearing was set for Feb. 18.

MARSHALL – Dustin Howard Martin, 18, of Ghent, was sentenced in Lyon County District Court Feb. 3 for charges of ineligible possession of a firearm. Martin illegally possessed a gun in Ghent on Nov. 4, court records said. Martin received a stayed sentence of five years in prison and five years probation with conditions including serve 270 days in jail with credit for 87 days already served, abstain from alcohol and drugs and complete 62 hours of Sentenced to Service.

MARSHALL Joseph David Gabler, 31, pleaded innocent in Lyon County District Court Feb. 3 to charges of failing to notify law enforcement of an address change and predatory violation – failure to verify address. A complaint alleges Gabler failed to notify law enforcement of a change of address in Marshall on June 13 and failed to return an address verification form mailed to him. A trial date was set for March 12, with a date certain of June 5. A pretrial hearing was set for March 4.

MARSHALL – Michael Thomas Vanwatermeulen, 28, of Marshall, pleaded innocent in Lyon County District Court Feb. 3 to two counts of domestic assault, possession of a small amount of marijuana and possession of drug paraphernalia charges. A complaint alleges Vanwatermeulen assaulted a woman in Marshall on Oct. 28. A trial date was set for March 13, with a date certain of June 18. A pretrial hearing was set for March 14.
