Suite Liv’n owners release statement on Sunrise Court

MARSHALL — The new owners of the Sunrise Court apartment complex in Marshall said “life-threatening safety issues” with the buildings’ heating systems were the reason they decided to terminate tenants’ leases.

On Wednesday, L2C, LLC, doing business as Suite Liv’n, released a statement on the situation with Sunrise Court. The press release was the first communication the Independent received from Suite Liv’n since September, when Sunrise Court residents were asked to vacate the building.

The issue was the subject of a civil case in Lyon County District Court, where three petitions from tenants were filed against the property’s new owners. A judge ruled that Suite Liv’n had to begin fixing the boilers at Sunrise Court, but the ruling didn’t say anything about upholding the tenants’ leases.

“The health, safety and welfare of the tenants of Sunrise Court Apartments are the primary concern of L2C, LLC,” the press release said. The release said a heating and ventilation expert found numerous safety issues with the heating systems, as well as illegal safety overrides that could have resulted in the release of poisonous carbon monoxide gas.

“Due to these life-threatening safety issues, Suite Liv’n made the difficult decision to terminate leases and direct tenants to vacate the buildings,” the release said.

Suite Liv’n said the business has worked with the city of Marshall and the Marshall Economic Development Authority to provide tenants with references to available rental units elsewhere. The release said Suite Liv’n waived October rent for residents, and will return residents’ full damage deposits.
