Hexum faces burglary charges

Balaton resident serving prison sentence for 2014 attempted murder

MARSHALL — A Balaton resident convicted in the 2014 shooting of a man near Granite Falls was back in Lyon County District Court on Tuesday.

Devin Donald Hexum, 24, was charged in connection with burglaries at the Marshall Golf Club and Borch’s Sporting Goods in 2014.

The two burglaries happened before the July 2014 shooting for which Hexum was convicted. Hexum has been incarcerated after pleading guilty to second degree attempted murder in the shooting of Daniel Scheff. Court records said Hexum shot Scheff on a gravel road south of Granite Falls in July 2014, after Devin and his brother Derek Hexum gave Scheff a ride in their vehicle. Devin Hexum was sentenced to more than 10 years in prison for the attempted murder charges.

On Tuesday, Hexum appeared in custody in Lyon County District Court on two separate criminal files. In one file, Hexum was charged with third degree burglary in connection with a burglary at the Marshall Golf Club on June 30, 2014. A complaint alleges Hexum stole items including golf clubs and bags, as well as cash, from the club.

In the second file, Hexum was charged with third degree burglary in connection with a burglary at Borch’s on July 3, 2014. A complaint alleges Hexum stole handguns, rifles and ammunition from the sporting goods store.

The criminal complaints allege that some of the stolen items were found at a rural Tyler residence. The complaints said informants told law enforcement that Hexum had asked to store the items there.

Both burglary charges are felonies, with a maximum sentence of five years in prison, said Judge Michelle Dietrich.

At Tuesday’s hearing, the court set a date for an omnibus hearing for both burglary charges. In an omnibus hearing, the court determines whether there is probable cause to pursue charges against a defendant. Dietrich said the hearing would normally have to be held within the next 28 days, unless Hexum chose to waive that deadline. Hexum asked to waive the 28-day period for the omnibus hearing, and a hearing date was set for Nov. 7.

Dietrich said she believed she would need to set bail for Hexum, even though he was not yet eligible for release from prison. Bail was set at $25,000 without conditions, or $15,000 cash or bond with conditions.
