YELLOW MEDICINE COUNTY,

ACTING AS DRAINAGE AUTHORITY FOR JUDICIAL DITCH #12 L&Y NOTICE OF

PUBLIC HEARING

REGARDING IMPOUNDMENT, REROUTE, OR DIVERTING OF

JUDICIAL DITCH #12 L&Y

Two Petitions for the Impoundment, Reroute, or Diversion of a portion of Lyon and Yellow Medicine Counties Judicial Ditch #12 were filed and are now pending for a decision. An Engineer's Report has been filed and is available for inspection at the Lyon County Auditor/Treasurer's Office located at 607 West Main Street, Marshall, Minnesota and the Yellow Medicine County Property & Public Services Office located at 180 8th Avenue, Granite Falls, Minnesota. A brief description of the proposed Impoundment, Reroute or Diversion is as followed:

Petitioners have worked with the Lyon County Soil and Water Conservation District, the Yellow Medicine County Soil and Water Conservation District, and the Board of Soil and Water Resources to place a perpetual conservation easement on certain properties owned by Petitioners in Section 3 of Vallers Township, Lyon County, Minnesota. In order to accomplish the purpose of the conservation easement, Petitioners must reroute a portion of open ditch and perforated drain tile existing on or providing drainage to said parcels in order to restore and preserve the wetland and upland habitat on the easement property. The existing Judicial Ditch #12 L&Y petitioned to be impounded, rerouted, or diverted lies within Sections 3 and 4 of Vallers Township, Lyon County, Minnesota and Section 34 of Normania Township, Yellow Medicine County, Minnesota.

A detailed description of the portions of J.D. #12 L&Y to be impounded, rerouted, or diverted can be found on file with the Lyon County Auditor's office and Yellow Medicine County Property and Public Services Office.

A description of the lands and properties which may be impacted by the impoundment, reroute, or diversion are located in the following sections and townships:

S 1/2 Section 3, T113, R41, Vallers Township, Lyon County

NW 1/4 Section 3, T113, R41,, Vallers Township, Lyon County

NE 1/4 Section 4, T113, R41, Vallers Township, Lyon County

North 1240 feet of the E 1/2 SE 1/4 Section 4, T113, R41, Vallers Township, Lyon County

SW 1/4 Section 34, T114, R41, Normania Township, Yellow Medicine County

The names of the owners and political subdivisions affected by the construction of the impoundment, reroute, or diversion to Judicial Ditch #12 L&Y are as follows:

Steve Olmstead, Rebecca Olmstead, George Laleman, Mark Louwagie and Diane Louwagie as Trustees under the Mark Louwagie Living Trust dated December 15, 2011, Diane Louwagie and Mark Louwagie as Trustees under the Diane Louwagie Living Trust dated December 15, 2011, Steven R. Doom as Trustee of the Trust Agreement of Stephen

R. Doom dated July 5, 2012, Brenda K. Doom as Trustee of the Trust Agreement of Brenda K. Doom dated July 5, 2012, Patrick Kremer, David Kremer and Debra Kremer as Trustees under the David and Debra Kramer Living Trust dated December 4, 2012, and the Vallers Township Board.

Notice is hereby given that the public hearing on the impoundment, reroute, or diversion of a portion of the existing Judicial Ditch #12 will be held on March 4, 2014 at 2:00 p.m. in Commissioner Rooms 1 & 2 at the Lyon County Government Center, 607 West Main Street, in Marshall, Minnesota. All persons affected by the proposed impoundment, reroute, or diversion are invited to attend and ask questions or make comments concerning the proposed impoundment, reroute, or diversion.
