ORDINANCE NO. 684, SECOND SERIES

AN ORDINANCE AUTHORIZING SALE OF INTOXICATING MALT LIQUORS

The Common Council of the City of Marshall does ordain as follows:

Section 1. Bridget's of Marshall Inc., dba Dickey's Barbeque Pit, a Minnesota Corporation, has been granted a City On-Sale Wine License as permitted by Minnesota Statutes and local ordinance.

Section 2. Bridget's of Marshall Inc., dba Dickey's Barbeque Pit has also been granted license to sell 3.2% malt liquors at on-sale pursuant to Minnesota Statutes and local ordinance.

Section 3. Minnesota Statute 340A.404 subd. 5b does authorize a municipality to authorize issuance of on-sale malt liquor license to applicant in accordance with the provisions of said statute, with the additional requirement that applicant have gross receipts of at least 60% attributable to the sale of food.

Section 4. The Common Council of the City of Marshall believes that all of the requirements of Minnesota Statute 340A.404 sudb 5b have been complied with and further deems it appropriate that the City of Marshall authorize the applicant to sell intoxicating malt liquors at on-sale without requirement for an additional license. Permission is therefore granted to applicant Bridget's of Marshall Inc., dba Dickey's Barbeque Pit for the sale of intoxicating malt liquors at on-sale without an additional license. That said intoxicating malt liquors shall be available through the applicant's business located at 900 Clarice Avenue, Marshall, Minnesota.

Section 5. This ordinance shall take effect from and after its passage and publication.

Passed and adopted by the Common Council this 17th day of December, 2013.
