UNOFFICIAL MINUTES-SUBJECT TO CORRECTIONS

LYON COUNTY BOARD OF COMMISSIONERS LYON COUNTY GOVERNMENT CENTER, MARSHALL, MN

January 5, 2010

9:00-Meeting was called to order by Chairman Stensrud. Members present: Stensrud, Fenske, Ritter, Nelson, Goodenow, County Attorney Maes, County Auditor/Treasurer Van Overbeke, and County Administrator Stomberg.

Goodenow nominated and was seconded by Ritter for Rodney Stensrud to be the 2010 Board Chair. VanOverbeke called three times for nominations. Hearing no other nominations they were closed. All voted in favor.

Fenske nominated and was seconded by Nelson for Steve Ritter to be the 2010 Vice-Chairman. VanOverbeke called three times for nominations. Hearing no other nominations they were closed.

Voting in Favor: Goodenow, Nelson, Fenske, Stensrud

Abstained: Ritter

Motion carried.

Ritter moved, seconded by Nelson to approve the agenda. All voted in favor.

Consent Agenda:

1.Approve Minutes from December 15, 2009

2.Approve Commissioner Warrants 118931-119026 in the amount of $409,872.48 dated 12/31/09 and 119027 -119036 in the amount of $44,340.54 dated 1/6/10.

3.Approve Auditor Warrants 118861 -118887 in the amount of $264,928.86 dated 12/17/09, 118900 -118918 in the amount of $21,125.19 dated 12/24/09, 118919 -118930 in the amount of $28,147.49 dated 12/31/09.

4.Approve Per Diems & Expenses

5.Designate www.lyonco.org as official website

6.Approve liquor license for Cottonwood Country Club

7.Approve 2010 GIS Department Fee schedule

8.Consider approval of the general services agreement with the Yellow Medicine Watershed District for GIS services

Stensrud - As a discussion item I would like to pull 7 and 8.

Nelson moved, seconded by Fenske to approve consent agenda items 1-6. All voted in favor.

Ritter moved, seconded by Goodenow to approve the 2010 GIS fee schedule. All voted in favor.

Fenske moved, seconded by Ritter to approve the general services agreement with Yellow Medicine Watershed District for GIS Services. All voted in favor.

Ritter moved, seconded by Nelson to approve and authorize the Chair to sign the welfare fraud investigation contract between the Lyon County Sheriff and Human Services. All voted in favor.

Ritter moved, seconded by Nelson to approve the Balaton Press-Tribune as the official paper for 2010. Seth Schmidt - We are proposing no increase for this year and 1% for next year and 0% for the following year. Elaine Snyder - Why is it the official minutes are not put in the paper? Stomberg- They are the ones that are in the vault. VanOverbeke - On the bottom of page one should that say 2012 and not 2009? All voted in favor.

Ritter moved, seconded by Goodenow to move forward with the interruptible generator program. All voted in favor. Ritter - I have talked with other businesses in town and they have been very pleased.

Goodenow moved, seconded by Ritter to approve and authorize the Chair to sign the 2008 to June 2010 Grant Agreement. Ritter- Of the remaining $8,366 where does the rest of it go? Biren - We dont have a plan anything it would have to be approved by this Board. It should be spent on something Environmental. Nelson - If we become a designated county then you are going to return every few years? That is going to take some personnel. Elaine Snyder - I was wondering if you could read it back on the minutes? All voted in favor.

Goodenow moved, seconded by Ritter to approve a subordination agreement with US Bank Home Mortgage on a Note and Septic System Lien owned by Lyon County for a septic system replacement loan granted to Mark and Janet VanKeulen in the amount of $7,400. Goodenow - We had talked about putting these on the consent agenda. Ritter - Are those printed in the paper? Stomberg- We could put them under resolutions and contracts. All voted in favor.

Ritter moved, seconded by Goodenow to set the minimum salaries and have the 2009, 2010 and maximum listed in the minutes. All voted in favor.

Nelson moved, seconded by Ritter to approve and authorize the Chair to sign the data processing contract with Human Services. Ritter - Do you remember what the 09 dollar was? We had a discussion at our Human Services Board a few months ago. All voted in favor.

Ritter moved, seconded by Goodenow to reimburse Deputies on the cost difference between the $200 plan and the $1,200 plan through Auditor Warrants. Fenske - They are paying at the $200 rate does BCBS provide us with that? Stomberg- We know what the rate is and we had to get down to the three. We pay the single. If everyone meets the maximum we would be ahead. Nelson - Are they the only ones left on the $200? All voted in favor.

Fenske moved, seconded by Goodenow to approve the elected officials out of state travel policy. All voted in favor.

10:40 Ritter moved, seconded by Goodenow to go into Closed session for Department Head Annual Performance Review. All voted in favor.

Fenske moved, seconded by Goodenow to come out of closed session. All voted in favor.

Fenske moved, seconded by Goodenow to set the 2010 Assessors salary at $69,214.

Motion carried 4 to 1.
