MARSHALL - Tonya Marie Popowski, 32, of Marshall pleaded guilty in Lyon County District Court Oct. 20 to a charge of theft by wrongfully obtaining assistance. Popowski failed to report household income and wrongfully received about $5,600 in welfare payments from December 2004 to January, court records said. A related charge was dismissed. Popowski received a stay of imposition on a sentence and was placed on supervised probation for up to five years. Popowski must complete 300 hours of Sentence to Serve, pay restitution and follow other conditions.
MARSHALL - Christopher Franklin Geisler, 30, of Minneota pleaded guilty in Lyon County District Court Oct. 23 to a charge of controlled substance crime in the third degree-liability for crimes of another. Geisler possessed about 8.25 kilograms of marijuana an accomplice was going to sell on May 21, 2008 in Lyon County, court records said. The court ordered a pre-sentence investigation.
MARSHALL - George Don-Nell Travis, 45, of Lynd pleaded guilty in Lyon County District Court Monday to charges of second degree-refusal to test with aggravating factors of prior DWIs, obstructing the legal process and no valid Minnesota driver's license. Travis refused an alcohol test, struggled with a deputy and did not have a valid state license on May 28 in Lyon County, court records said. Travis was sentenced to one year in jail on the DWI charge and 245 days were stayed. Travis was placed on supervised probation. Travis must serve 120 days, have a chemical use assessment and follow other conditions. Travis was sentenced to one year in jail on the obstruction charge. The court stayed 245 days and placed Travis on supervised probation. Travis must serve a concurrent 120 day sentenced. Travis was sentenced to a concurrent 90-day sentence on the license charge.
MARSHALL - Justin Allen Miller, 23, of Tracy appeared in Lyon County District Court Monday on two counts of third degree driving while impaired. Miller drove under the influence of alcohol on Oct. 24 in Tracy, the complaint alleges. Cecil Naatz was appointed Miller's lawyer. A hearing was set for Nov. 9. Bail with no conditions was set at $6,000. Miller can also be released on no bail on the conditions he reappear in court, be of good behavior and others.
MARSHALL - Daniel Joseph Kittredge, 24, of Marshall pleaded guilty in Lyon County District Court Tuesday to a charge of controlled substance crime in the fifth degree-liability for crimes of another. Kittredge sold a half ounce of marijuana for $200 on Nov. 12, 2008 in Lyon County, court records said. The court ordered a pre-sentence investigation. A sentencing hearing was set for Nov. 24
MARSHALL - Kevin Joseph Janiszeski, 25, of Minneota appeared in Lyon County District Court Monday on charges of second degree driving while impaired and hit and run. Janiszeski drove under the influence of alcohol and did not report a collision with an unattended vehicle on Oct. 24 in Marshall., the complaint alleges. Stephen Ferrazzano was appointed Janiszeski's lawyer. Bail of $12,000 with no conditions was set and bail of $3,000 with conditions of reappear in court, be of good behavior and obey all laws was also set. A hearing was set for Nov. 9.
