MARSHALL - David Lee Norman, 24, of Pipestone pleaded guilty in Lyon County District Court Oct. 20 to charges of theft-liability for crimes of another and illegal possession of a prescription medication. Norman and an accomplice stole about $44 in items from a store and Norman possessed medication that was prescribed to another on Set. 18 in Marshall, court records said. Norman was sentenced to concurrent 90-day sentences on both charges and must follow conditions.

MARSHALL - Jose Alexis Colon-Alicea, 32, pleaded guilty in Lyon County District Court Oct. 20 to charges of first degree driving while impaired with the aggravating factor of prior DWIs in 2002, 2008 and 2009 in different states and open bottle. Colon-Alicea drove while impaired with alcohol and with an open container of beer in his vehicle on Aug. 15 in Marshall, court records said. Colon-Alicea was sentenced to 36 months in prison on the DWI charge and the sentence was stayed. Colon-Alicea was placed on up to seven years of probation and must serve 210 days in jail and follow conditions of obtain a chemical use assessment, obey laws and others. On the open bottle charge, Colon-Alicea was sentenced to 90 days to be serve concurrently. Two related charges were dismissed.

MARSHALL - Timothy Edward Whiting, 22, of Marshall pleaded guilty in Lyon County District Court Oct. 20 to a charge of financial transaction card fraud with the aggravating factor of a burglary conviction in 2008. Whiting used the debit card of another to make about $50 in phone calls on April 30 in Marshall, court records said. Whiting received a stay of imposition on a sentence and was placed on up to five years of supervised probation. Whiting must serve 30 days, complete a cognitive behavior program and follow other conditions.

MARSHALL - James Dudley Flood Jr., 50, of Lynd pleaded guilty in Lyon County District Court Oct. 20 to a charge of driving while impaired with the aggravating factor of a prior DWI in 2001. Flood drove under the influence of alcohol on May 9 in Lyon County, court records said. A related charge was dismissed. Flood was sentenced to one year in jail with 335 days stayed. Flood was placed on up to two years of supervised probation. Flood must serve 30 days, pay a $600 fine and follow other conditions.

MARSHALL - Timothy Michael Freking, 54, of Brewster appeared in Lyon County District Court Oct. 19 on charges of third degree driving while impaired-test refusal, fourth degree DWI, obstructing the legal process, open bottle and over the center line. Freking drove over the center line, drove under the influence of alcohol, refused to cooperate with a deputy, refused an alcohol test and had an open bottle of alcohol in his vehicle in October in Lyon County, the complaint alleges. Bail with no conditions was set at $12,000 and bail of $600 with conditions including reappear in court, abstain from alcohol and drugs, and submit to random testing. A hearing was set for Nov. 12.
