MARSHALL - Eric Theodore Sovell, 26, whose address was listed as the Lyon County jail appeared in Lyon County District Court Sept. 1 in a probation violation hearing. Sovell failed to abstain, failed to remain law abiding and failed to pay what he owed, court records said. Sovell was sentenced to 28 months in prison. In a separate file, Sovell was sentenced to concurrent 90 day sentence on a driving after revocation charge.
MARSHALL - Mark Thomas Gruhot, 49, of Marshall pleaded guilty in Lyon County District Court Sept. 1 to a charge of driving after cancellation-inimical to public safety. Gruhot drove with a canceled driver's license on May 21 in Marshall, court records said. The court ordered a pre-sentence investigation. A sentencing hearing was set for Sept. 29.
MARSHALL - Kevin Dean Cleveland, 30, of Marshall admitted in Lyon County District Court Sept. 1 violating his probation. Cleveland violated his probation by failing to complete Sentence to Serve and failing to pay restitution, court records said. Cleveland was reinstated on probation.
MARSHALL - Michael Alan Swanson, 48, of Balaton pleaded guilty under the Alford plea in Lyon County District Court Sept. 4 to a charge of predator offender violation. Under an Alford plea, Swanson does not admit guilt but says based on the evidence, a jury could find him guilty of failing to return an address verification card within the required time from April 28 to Nov. 3, court records said. Swanson received a stay of adjudication on a sentence and was placed on unsupervised probation on conditions including complete all BCA paperwork.
MARSHALL - Nicholas Adam Olson, 26, of Clear Lake, S.D., was sentenced in Lyon County District Court Sept. 9 on a charge of domestic assault by strangulation. Olson received a stay of imposition on a sentence and must pay a $500, serve 60 days in jail and follow other conditions. Two related charges were dismissed by the court.
MARSHALL - Allan Lee Skare, 33, of Marshall did not appear in Lyon County District Court Sept. 15 on charges of assault in the second degree, domestic assault-strangulation and obstructing the legal process. Skare threatened a victim with a knife, choked the victim and struggled with law officers on July 31 in Marshall, the complaint alleges. Skare's lawyer said Skare was in custody in another county. The court ordered a warrant to be issued.
MARSHALL - Chad Allen Weyh, 20, of Marshall pleaded guilty in Lyon County District Court Sept. 15 to a charge of third degree driving while impaired with the aggravating factor of a prior DWI in 2003. Weyh drove with an alcohol concentration of .14 on June 26 in Marshall, court records said. Weyh was sentenced to one year in jail and 335 days were stayed. Weyh must serve 30 days, pay what he owes and follow other conditions. A related charge was dismissed.
MARSHALL - Jason James Montgomery, 23, of Montevideo admitted in Lyon County District Court Sept. 15 violating his probation. Montgomery violated his probation by failing to be of good behavior and obey all laws. The court continued a stay of execution of a sentence. Montgomery was reinstated on probation on prior conditions and must serve 45 days on electronic home monitoring.
MARSHALL - Christopher Franklin Geisler, 30, of Minneota pleaded innocent in Lyon County District Court Sept. 9 to charges of controlled substance crime in the third degree-intent to sell and liability for crimes of another, controlled substance crime in the fifth degree and child endangerment. Geisler allowed an accomplice to deliver 8.25 kilograms of marijuana that the accomplice intended to sell to his residence on May 21 in Minneota, the complaint alleges. Geisler and an accomplice possessed 1/4 pound of marijuana in Minneota with children were in the residence, the complaint alleges. A jury trial was set for Oct. 29.
MARSHALL - Sonia G. Ramirez, 32, of Marshall appeared in Lyon County District Court Sept. 8 on charges of theft by wrongfully obtaining assistance and perjury. Ramirez made false statements on welfare forms and failed to report household income and received an overpayment of about $2,200, the complaint alleges. Lyon County Assistant Attorney Tricia Zimmer and Ramirez's lawyer Joel Solie filed documents. An omnibus hearing was set for Oct. 6.
MARSHALL - Noah Daniel Arjun Mayer, 23, of Marshall appeared in Lyon County District Court Sept. 8 on a charge of theft. Mayer stole $760 from a business safe on April 12 in Marshall, the complaint alleges. Mayer's lawyer Cecil Naatz filed papers. An omnibus hearing was set for Oct. 6.
MARSHALL - Jason Thomas Amundson, 29, of Arco appeared in Lyon County District Court Sept. 8 on charges of assault in the second degree, burglary in the first degree and terroristic threats. Amundson pointed a loaded shotgun at a victim, entered a residence without consent and threatened a victim on Aug. 12 in Lyon County, the complaint alleges. Amundson's lawyer Cecil Naatz and Lyon County Attorney Rick Maes had filed papers. An omnibus hearing was set for Oct. 6.
