10 arrested in area drug bust are charged in Lyon County District Court

The 10 people arrested Thursday in a drug bust by the Brown, Lyon and Redwood Drug and Gang Taskforce appeared in Lyon County District Court Thursday on drug charges which ranged from controlled substance crime in the fifth degree to controlled substance crime in the first degree. The charges did not stem from a single incident in which all defendants were involved.

Nichole Ann Hively, 24, of Marshall is charged with controlled substance crime in the first and second degree, both with liability for crimes of another. Hively and an accomplice sold 13.7 grams of methamphetamine for $1,500 on July 10 in Marshall, the complaint alleges. Hively and an accomplice sold 6.6 grams of methamphetamine for $750 on July 30 in Marshall, the complaint alleges. Bail was set at $50,000 with no conditions and at $25,000 with conditions including reappear in court, do not leave the state without permission and submit to random urinalysis.

Richard Howard Schultz, 22, of Cottonwood appeared on charges of controlled substance crime in the first degree and controlled substance crime in the fifth degree-liability for crimes of another. Schultz sold 15.5 grams of cocaine for $780 on April 23 in Marshall, the complaint alleges. Schultz and an accomplice sold one ounce of marijuana for $200 on April 16 in Marshall, the complaint alleges. Bail was set at $50,000 with no conditions and at $25,000 with conditions including reappear in court, be of good behavior and submit to random urinalysis.

Melissa Jean Barker, 41, of Marshall is charged with second degree controlled substance crime. Barker sold 62 capsules containing an amphetamine on July 30 in Marshall, the complaint alleges. Bail was set at $40,000 with no conditions and at $5,000 with conditions including reappear in court, be of good behavior and submit to random urinalysis.

Shannon Crycle Dela Pena Hansen, 18, of Ivanhoe is charged with controlled substance crime in the third degree and controlled substance crime in the fifth degree, liability for crimes of another. Hansen conspired with a person under 18 for the sale of a half ounce of marijuana for $200 on Sept. 23 in Marshall, the complaint alleges. Hansen arranged for the sale of that marijuana, the complaint alleges. Bail was set at $10,000 with no conditions. Bail was set at $5,000 with conditions including reappear in court, be of good behavior and submit to random urinalysis.

Michael Casey McGovern, 20, of Marshall is charged with controlled substance crime in the fifth degree-liability for crimes of another. McGovern arranged for the sale of one ounce of marijuana for $200 at his apartment on April 16 in Marshall, the complaint alleges. Bail was set at $5,000 with no conditions. McGovern can also be released without bail on conditions including do not leave the state, be of good behavior and submit to random testing.

Darren Ross Serreyn, 20, of Lynd is charged with controlled substance crime in the fifth degree, liability for crimes of another. Serreyn and an accomplice sold a half ounce of marijuana for $200 on Nov. 12 in Marshall, the complaint alleges. Bail with no conditions was set at $5,000 and bail of $1,000 with conditions including reappear in court, obey laws and submit to random testing was also set.

Judy Marie Henderson, 29, of Marshall is charged with simulated controlled substance crime. Henderson sold 70 pills she said were ecstasy for $1,100 on July 30 in Marshall, the complaint alleges. Bail with no conditions was set at $5,000. Bail of $1,000 with conditions including be of good behavior and submit to random urinalysis was also set.

Daniel Joseph Kittredge, 24, of Marshall is charged with controlled substance crime in the fifth degree-liability for crimes of another. Kittredge and an accomplice sold a 1/4 ounce of marijuana for $200 on Nov. 12 in Marshall, the complaint alleges. Bail was set at $10,000 with no conditions. Bail was set at $5,000 with conditions including be of good behavior, obey laws and submit to random urinalysis.

Timothy Martin Zander, 28, of Marshall is charged with controlled substance crime in the fifth degree. Zander sold a half ounce of marijuana for $200 on Oct. 23 in Marshall, the complaint alleges. Bail was set at $5,000 with no conditions and at $1,000 with conditions including be of good behavior and submit to random urinalysis.

Seth Andrew Micaiah Johnson, 25, of Marshall is charged with controlled substance crime in the fifth degree. Johnson sold one ounce of marijuana for $350 on March 16 in Marshall. Bail was set at $5,000 with no conditions and at $1,500 with conditions including reappear in court and submit to random urinalysis.

Court hearings were set for June 23 for Serreyn, Henderson and Kittredge,

Court hearings were set for June 30 for McGovern, Hively, Zander, Johnson, Schultz, Barker and Hansen.

Public defenders were appointed for all the defendants except McGovern.

Yes, while cocaine, methamphetamine, and ****** (?) are major problems, marijuana is tolerated in many larger metro areas due to its lack of harm to all those except individuals who choose to participate in its use. It is a less harmful substance than alcohol and it is being treated almost the same as coke or smack in the legal system. I do believe that posting $10,000 bail for the sale of a 1/2 ounce of marijuana to be completely absurd. It is forcing unnecessary police control on the small society of Marshall.

Oldlady, the Police do not arrest for no reason. If they did that there would be lawsuits everyday. Why dont you nose a little farther into the Police's business and find out the real facts. You should be happy these people are being taken off the streets, afterall, criminals have been proven to target the elderly more than any other age group.

Gretta, they were arrested because they were involved in a drug deal. Does it really matter which drug it was? The police are not trying to get one drug off the streets they are trying to get all of them off. You ever heard of a Gateway Drug? Get your head out of your ***!

The Police are just doing their job. If you look suspicious they are going to stop and talk to you and make sure everything is ok. They dont know who you are..... you could methed up with a gun, they dont know. Put yourself in their shoes. If the world didnt have a bunch of crazy idiots and life was a big "Full House" episode the police wouldnt have to stop and question everyone. If you dont like it, Move! And if you dont appreciate the police, dont call and ask for one to help you in an emergency!

Oldlady, I agree with you. The Marshall PD has even harrassed my dad because he was walking home from work at 2am thinking he was drunk because he was walking at night. My dad doesnt drink at all!

I am an older citizen from the area and have no respect for the Marshall police department. I have witnessed how they treat our young adults. Arresting them because they can for no reason. The old saying is "criminals and cops are the same, both picked on in high school" Sure I want drug's off the street's but I think there is some drama involved here too. Innocent til proven guilty or til they can't afford to fight it any more. Taxes will go up over this one because who pays the public defender?

Im not saying it's okay to sell pot. I just think that Marshall's meth problem should be their main focus.

Well you see Gretta, that 1/4 ounce is part of a pound. That pound is part of a trunk load. That trunk load is part of a...you get the point. The "cops" are trying to keep these sellers out of town...and away from kids like mine! As far as i'm concerned I hope they keep it up!

Okay, I understand the arrests for cocaine, meth, and ******* but selling a 1/4 ounce of pot? Dont the Marshall cops have anything better to do?
