MARSHALL - Timothy John Cox, 45, of Marshall appeared in Lyon County District Court May 6 on two counts of third degree driving while impaired with the aggravating factor of a prior DWI in 2008. Cox drove with an alcohol concentration of .19 on March 28 in Marshall, the complaint alleges. Cox waived his court time line. Cox's lawyer Greg Solomon filed papers. Cox was released without bail on the conditions he reappear in court be of good behavior, obey laws and others. A hearing was set for June 14. Solomon requested the file be sealed from the public and the media but the request was not granted at this time.

MARSHALL - Jesse James Andres, 28 of Ruthton appeared in Lyon County District Court May 6 on two counts of third degree driving while impaired with the aggravating factor of a prior DWI in 207. Andres drove with a blood alcohol concentration of .17 on March 14 in Lyon County, the complaint alleges. Andres said he would hire his own attorney. Andres was released on conditions he does not leave the state without permission, reappear in court and others. A hearing was set for May 19.

MARSHALL - Eric Michael Guttum, 33, address unknown, appeared in Lyon County District Court May 5 on a charge of predatory offender-failure to register. Guttum did not notify authorities within the required time of a change in his address in December and January in Lyon County, the complaint alleges. Lyon County Attorney Rick Maes asked the court to rescind an order. The court revoked Guttum's furlough. Guttum will be held until sentencing.

MARSHALL - Bobbi Jo Kirong, 28, of Marshall appeared in Lyon County District Court May 6 on charges of theft by wrongfully obtaining assistance and perjury. Kirong failed to report household income from June to December in Lyon County and falsely signed welfare documents and received an overpayment in assistance of about $1,200, the complaint alleges. Kirong was released on conditions including reappear in court, do not leave the state without permission and report address change.

MARSHALL - Yer Moua, 41, of Tracy appeared in Lyon County District Court May 6 on a charge of theft by wrongfully obtaining assistance. Mou failed to report household income in August, September and October 2007 and received about $1,000 in an overpayment, the complaint alleges. A hearing date was set.

MARSHALL - Kimberly Sunbrean Harden, 40, address unknown, appeared in custody Lyon County District Court May 7 on charges of aggravated forgery and perjury. Harden signed the name of another person on a welfare document from April 5 to May 1 and made false statements in an application for emergency welfare assistance on April 17, the complaint alleges. Harden also appeared in a probation violation in a second file. Harden failed to pay restitution, attend a course, abstain from alcohol and drugs, to follow a chemical use assessment, to report address change and maintain contact, probation alleges. A public defender was to be appointed in the new charges filed. Bail with no conditions was set at $30,000. Bail of $20,000 with conditions including reappear in court and do not leave the state without permission was also set. Harden was reinstated on bail of $10,000 in the probation violation file and at $5,000 with conditions. The bail is in addition to the charges file. A hearing on both files was set for May 26.

MARSHALL - Justin Lee Lewis, 20, of Marshall appeared in custody Lyon County District Court May 7 in a criminal sexual conduct file. Lewis sexually assaulted a victim, 14, in December 2007 and January 2008 in Marshall, the complaint alleges. A public defender was to be appointed. Bail with no conditions was set at $90,000 and at $60,000 with conditions including reappear in court and obey all laws. A revocation hearing was set for May 15.
