MARSHALL - Adam Wayne Rager, 23, of Marshall, formerly of Lynd, appeared in Lyon County District Court April 27 on a charge of driving under the influence of a controlled substance. Rager drove after he took more than the prescribed dose of prescribed medication on Dec. 4 in Marshall, the complaint alleges. Marshall Assistant City Attorney Lori Buchheim and Rager's lawyer Joel Solie filed papers. An omnibus hearing was set for May 26.
MARSHALL - Martin Dale Empson, 42, of Cottonwood pleaded guilty in Lyon County District Tuesday to an amended charge of fourth degree driving while impaired. Empson drove under the influence on March 15 in Marshall, court records said. Empson was sentenced to 90 days with all days stayed and was placed on probation for up to one year. Empson must also pay a $600 fine and follow other conditions.
MARSHALL - Chad Jerome Renneke, 26, of Marshall pleaded guilty in Lyon County District Court Tuesday to charges of third degree driving while impaired with the aggravating factor of a prior DWI in 2005. Renneke was sentenced to one year in jail with 320 days stayed and was placed on supervised probation. Renneke must serve 45 days in jail, pay a $600 fine and follow other conditions. A related charge was dismissed.
MARSHALL - Dence Ker, 27, of Tracy pleaded guilty in Lyon County District Court Tuesday to a charge of third degree driving while impaired-refusal to test. Ker refused an alcohol test on Jan. 31 in Tracy, court records said. Ker was sentenced to 120 days in jail with all 120 days stayed. Ker was placed on supervised probation for up to two years, and he must pay a $900 fine, have a chemical use assessment and follow other conditions. Five related charges were dismissed.
MARSHALL - Nicholas James Berry, 28, of Morton appeared in Lyon County District Court Tuesday on charges of controlled substance crime in the second degree-liability for crimes of another and controlled substance crime in the third degree and fifth degree. Berry and an accomplice possessed five grams of methamphetamine they intended to sell on Nov. 20 in Marshall, the complaint alleges. Berry possessed five grams of methamphetamine and 10.7 ounces of marijuana on Nov. 20 in Marshall, the complaint alleges. Berry's lawyer Joel Solie asked for a continuance and Berry waived his court time line. An omnibus hearing was continued to June 9. Berry was released on prior conditions.
MARSHALL - Sherry Jane Smith, 45, of Gary, S.D., pleaded guilty in Lyon County District Court Tuesday on a charge of issuance of a dishonored check. Smith wrote a check for about $373 on Nov. 3 in Marshall that was returned as account closed, court records said. Smith was sentenced to 180 days in jail which was stayed and was placed on supervised probation for up to two years. Smith must serve 20 days on electronic home monitoring, pay a $600 fine and follow other conditions.
