Courts for April 25-26
MARSHALL - Jessica Grace Walters, 27, of Marshall was sentenced in Lyon County District Court April 7 on a charge of second degree refusal to test with the aggravating factor of prior DWIs in 2005 and 2006. Walters was sentenced to one year in jail with 275 days stayed and placed on up to two years of supervised probation. Walters must serve 90 days in two 45-day sentences, pay a $700 fine and follow other conditions. Two related charges were dismissed.
MARSHALL - Kimberly Sunbrean Harden, 40, of Marshall appeared in custody in Lyon County District Court April 13 in a probation violation hearing. Harden violated her probation by failing to pay restitution, failing to attend required course, failing to abstain from drugs, failing to follow a Chemical Use Assessment, failing to report an address change and failing to maintain contact with probation, probation alleges. Bail without conditions was set at $10,000. Bail with conditions including submit to random testing and reappear in court was set at $5,000.
MARSHALL - Everett Wilburn, 25, of St. Paul appeared in custody in Lyon County District Court April 13. Wilburn denied violating his probation. Wilburn violated his probation by failing to maintain contact with probation, failing to complete 168 hours of Community Work Service, failing to provide authorities a copy of information from Southwest Minnesota State University and failing to notify probation of police contact, probation alleges. Bail was set at $20,000 with no conditions. Bail of $15,000 with conditions including reappear in court, do not leave the state without permission and no contact with witnesses was also set. A hearing was set for April 21.
MARSHALL - Brittany Beth Sandager, 21, of Marshall pleaded guilty in Lyon County District Court April 14 to a charge of third degree driving while impaired. Sandager drove with an alcohol concentration of .20 on March 1 in Marshall, court records said. The charge will be misdemeanor by sentence. Sandager was sentenced to 90 days in jail which was stayed for up to one year. Sandager was placed on supervised probation for up to one year. Sandager must serve 10 days in jail, pay a $600 fine and follow other conditions. A related charge was dismissed.
MARSHALL - Todd Duane Wixon, 29, of Balaton appeared in Lyon County District Court April 14 in a motion hearing. Wixon's lawyer Cecil Naatz moved to convert Wixon's sentence. The court ordered Wixon to serve 30 days of a modified sentence and to provide upon his adjudication of guilty to fifth degree assault and Wixon will be sentenced to 90 days. Sixty of those days will be stayed and Wixon must serve 30 days and was placed on supervised probation for up to one year, concurrent with another file.
MARSHALL - Berlon Rushoud Curry, 27, of Marshall appeared in Lyon County District Court April 14 on charges of assault in the second degree, terroristic threats and possession of a handgun without a permit. Curry pointed a gun and chambered a round to scare a victim on March 27 in Marshall, the complaint alleges. Curry did not have a permit to carry a handgun, the complaint alleges. Curry waived his court timeline. An omnibus hearing was set for May 26. Curry's lawyer Stephen Ferrazzano and Lyon County Attorney Rick Maes filed papers. A hearing was set for May 26.
