February 17, 2009
9:00 a.m. - Meeting called to order by Chairman Stensrud.
Members present: Fenske, Nelson, Ritter, Goodenow, Stensrud, County Administrator Stomberg, County Attorney Maes, Auditor/Treasurer VanOverbeke.

Fenske moved, seconded by Nelson to approve the agenda. All voted in favor.

1.Approve Minutes from February 3, 2009
2.Approve Commissioner Warrants 115454-115455 in the amount of $116.05 dated 2/18/09 and 115361-115453 in the amount of $377,140.93 dated 2/18/09.
3. Approve Auditor Warrants 115289-115307 in the amount of $259,599.60 dated 2/5/09 and 115308 - 115336 in the amount of $255,438.34 dated 2/12/09.
4. Approve Per Diems & Expenses
Goodenow moved, seconded by Nelson to approve the consent agenda. All voted in favor.
Nelson moved, seconded by Goodenow to approve and authorize the Chair to sign a resolution allowing Lyon County to conduct a Feedlot Inventory.
Ritter - This is a perfect fit for Planning and Zoning. Nelson - I also think with the economy the way it is people won't be building as much so it is a good time to work it in. Biren - With Soil and Water we will have a presentation for the Board regarding the work plan and Soil and Water will help us put it together. All voted in favor. (Resolution 07-09 on file at the County Administrator's Office).
Fenske moved, seconded by Ritter to grant the Lyon County Highway Department a Conditional Use Permit for a gravel pit (extract, mine and process gravel). This request is an amendment to the Conditional Use Permit granted to Gladys Grant in September of 2005. Amendment request is to add a haul road: 120th Avenue to CSAH 4.The property is owned by Gladys Grant, Galen and Marie Grant, Gregory and Lori Grant and Greta and Robert Lintelman. The property is zoned agricultural and described as the North Half of the Northeast Quarter (N1/2 NE1/4) and the South Half of the Northeast Quarter (S1/2 NE1/4) and the Northwest Quarter (NW1/4), of Section 29, Island Lake Township. As per recommendation of the Lyon County Planning Commission and the Island Lake Township Board. With the following stipulations:
1. Conditional Use Permit will be reviewed annually.
2. Conditional Use Permit is granted for 40 acres or the life of the operation whichever is less.
3.Top soil will be stockpiled and used for reclaiming and leveling.
4. Reclaiming and leveling of land is to be done as work progresses.
5. Grade site after extraction is completed so as to render it usable, seeding required avoiding erosion and an unsightly mar of the landscape.
6.Must maintain a backslope of 4:1 or flatter.
7.Responsible for maintenance on roads that trucks will be hauling on.
8. Responsible for dust control on haul roads.
9. Haul roads designated as: 240th Street to 130th Avenue to CSAH 4 and 120th Avenue to CSAH 4.
10. Owner must notify the Lyon County Zoning Office when work is complete.
11. Must obtain permits from appropriate agencies.
12. A copy of the Lyon County Board of Commissioner's Motion shall be filed with the County Recorder's Office along with the legal description of the property. Additional fees to be paid by the applicant for the actual costs incurred by the county for the recording fees.
13. Must comply with Soil and Water and DNR regulations.
All voted in favor.
Consider approval to hire summer help for Public Works projects
Ritter moved, seconded by Goodenow to deny the request. Fenske - If none of these are hired what would be the implications? Kanwar - If we have a stimulus project we need to have staff for all our federal projects. We need to have an inspector on each project. We have two certified inspectors. The other option we have is to request a private contractor.
The minimum is $90.00 per hour versus $13.00 per hour. Goodenow - My concern with this is it is too wide open. I look at the request to hire summer help as we always did. Maybe the ditches won't get mowed as much.
Nelson - Mowing the ditches is a safety factor. Kanwar - I can put a comparison together for 2008 versus 2009. Fenske - For example maybe we don't need two parks people. Fenske - Now the motion is to deny it? Does it deny it permanently or can he bring it back? Stomberg - In the past they have hired their summer help without coming to the Board.
Voting in Favor: Stensrud, Ritter, Goodenow
Opposed: Nelson, Fenske
Motion Carried 3 to 2.
Nelson moved, seconded by Ritter to approve and authorize the Chair and County Administrator to sign agreement number 93949 with MNDOT. All voted in favor. (Resolution 08-09 on file at the County Administrator's Office).
Fenske moved, seconded by Ritter to approve the amendment to the original recycling contract. Nelson - On page 2 to 3 to now therefore number 1. The county will make arrangements for distribution and number seven says the contractor. Who is going to do it? Henriksen - We will do the initial and they will do the change. Maes - If you want to add on 7 A after initial distribution. Ritter - What is the start date? Henriksen-April. Fenske
-Have they located enough carts for us? Henriksen - No. All voted in favor.
Goodenow - I assume we are putting out the same size or are you going to have them call? Discussion.
Ritter moved, seconded by Fenske to approve the purchase of used recycling carts from Waste Management. Ritter - Lyon County's logo what are we going to do for that? Henriksen - I am looking for a sticker and it would be on the side as you are driving towards the cart to pick it up. Ritter - I think it would be a good idea for you to go to each council meeting to explain it. All voted in favor.
Fenske moved, seconded by Goodenow to allow Anthony Rolling to go to out of state training in Fort Dodge, Iowa from March 9 through 13, 2009. All voted in favor.
Ritter moved, seconded by Nelson to purchase one Dodge Charger from Lockwood Motors, Inc. for $22,800 with a trade in. Fenske - This is for one? Ritter- We need to be more cost conservative. I had a van I drove for my business that had 300,000 miles. All voted in favor.
Goodenow moved, seconded by Ritter to transfer the van from the general motor pool to the Sheriff's Department. All voted in favor.
Goodenow moved, seconded by Ritter to accept the resignation of Philip Myhrberg effective February 27, 2009. All voted in favor.
Ritter moved to advertise for a fully licensed person to work part time.
Motion failed due to lack of a second. Goodenow moved, seconded by Fenske to hire a temporary full time Deputy for one year. Nelson - You are hiring a full time licensed employee? Goodenow - Yes at the most it would be a year. All voted in favor.
Ritter moved, seconded by Fenske to accept the resignation of Judy Sorenson effective February 3, 2009. All voted in favor.
Fenske moved, seconded by Nelson to authorize hiring Whitney Gregoire at an hourly rate of $13.81 per hour and effective date of February 17, 2009. All voted in favor. Stomberg - There are two more we need to add? Do you propose we go through an advertising process again? Marks - Yes.
