MARSHALL - Yenny Angelica Pila Mendoza, 22, of Marshall pleaded guilty in Lyon County District Court Sept. 15 to a charge of aggravated forgery. Mendoza used the Social Security number and identity of another person to obtain employment in Marshal on May 28. Mendoza must serve 60 days in jail, pay a $500 fine and follow other conditions. A related charge was dismissed.
MARSHALL - Osbaldo Lopez, 19, of Marshall appeared in Lyon County District Court Sept. 16 on charges of giving a false name and date of birth to police and minor consumption. Lopez consumed alcohol and gave police the name and date of birth of another person on Sept. 5 in Marshall, the complaint alleges. Lopez's lawyer Cecil Naatz had filed papers. An omnibus hearing was set for Oct. 14. Lopez was released on his own recognizance.
MARSHALL - Jonathan Andrew Claeys, 19, of Ghent pleaded guilty in Lyon County District Court Sept. 16 to two counts of obstructing the legal process. Claeys physically resisted officers on Aug. 3 in Ghent, court records said. Claey was sentenced to 180 days in jail on each count and both sentences were stayed. Claeys was placed on supervised probation for up to two years. Claeys must complete 40 hours of Community Work Service, abstain from alcohol and drugs and follow other conditions. Four related charges were dismissed.
MARSHALL - Shirwa Mohamed Nur, 26, of Marshall did not appear in Lyon County District Court Sept. 12 in a probation violation hearing. The hearing was continued to Sept. 18. Nur violated probation by failing not to use or possess alcohol or drugs and failing to pay what he owes, probation alleges.
MARSHALL - Kody Stephen Evers, 21, of Milroy appeared in Lyon County District Court Sept. 15 on charges of third degree driving while impaired ,and fourth degree DWI and exhibition driving. Evers drove while impaired and in exhibition on Sept. 4 in Marshall, the complaint alleges. Evers' lawyer Cecil Naatz had filed papers. Evers may still hire Bob Gjorvad. An omnibus hearing was set for Oct. 14.
MARSHALL - Jessica Grace Walters, 27, of Balaton appeared in Lyon County District Court Sept. 12 on charges of second degree driving while impaired-refusal to test, second degree DWI, both with the aggravating factor of prior DWIs in 2005 and 2006 and stop, stand or park in highway. Walters drove while impaired with alcohol, refused an alcohol test and stopped on a county road on May 2 in Lyon County, the complaint alleges. There was no settlement in the case. A continuance was granted. A jury trial was set for Dec. 10. A motion in Limine hearing was set for Nov. 18.
MARSHALL - Brent Bennett Gulbranson, 29, of Albuquerque, N.M., appeared in Lyon County District Court Sept 12 in a sentencing hearing. Gulbranson received a stay of imposition on a sentence on a controlled substance crime in the first degree charge. Gulbranson was placed on supervised probation for up to one year. Gulbranson must serve one year in jail, pay a $1,000 fine and follow other conditions. The sentence is a departure from guidelines pursuant to a plea agreement.
MARSHALL - Jimmy Alexander Gogoi of Minneapolis appeared in Lyon County District Court Sept. 15 on a charge of burglary in the second degree. Gogoi and an accomplice entered a residence without consent and stole items on June 13 in Marshall, the complaint alleges. A Rule 8 hearing was set for Sept 29. Cecil Naatz was appointed Gogoi's lawyer. Bail with no conditions was set at $10,000. Gogoi can also be released on no bail on conditions he reappear in court, obey laws and others.
MARSHALL - David Jose Swanson, 28, of Marshall pleaded guilty in Lyon County District Court Sept. 16 to a charge of second degree driving while impaired with the aggravating factor of prior DWIs in 2001 and 2002. and a charge of driving after revocation. Swanson drove with a revoked license and with an alcohol concentration of .15 on Aug. 10 in Marshall, court records said. Swanson was sentenced to one year in jail with 275 days stayed on the DWI charge and was placed on probation for up to two years. Swanson must serve 90 days in jail, pay $700 and follow other conditions. On the DAR charge, Swanson must serve a concurrent 90-day sentence.
MARSHALL - David Eugene Brush, 18, of Marshall appeared in Lyon County District Court Sept. 16 on a charge of financial transaction card fraud. Brush used a victim's debit card to make about $472 in purchases April 7-14 in Lyon County, the complaint alleges. A pre-sentence investigation was ordered. Brush is to meet with probation on Oct. 14.
MARSHALL - Michael Robin Larsen, 40, of Marshall pleaded guilty in Lyon County District Court Sept. 16 to a charge of controlled substance crime in the fifth degree. Larsen sold a prescribed controlled substance for $100 on March 2 in Lyon County, court records said. Larsen was sentenced to one year in jail with 335 days stayed and was placed on supervised probation for up to two years. Larsen must serve 30 days in jail, have a chemical use assessment and follow other conditions.
