Courts for Sept. 8
MARSHALL - Jonathan William Schmuhl, 24, of Ivanhoe appeared in Lyon County District Court Aug. 21 on two counts of second degree driving while impaired with the aggravating factor of a prior DWI in 2002 and a charge of driving after revocation. Schmuhl drove with a blood alcohol concentration of .16 and a revoked license in Lyon County on July 13, the complaint alleges. The court took the case under advisement and Judge Michelle Dietrich issued an order later on Aug. 21 which said she found probable cause.
MARSHALL - Juan Antonio Ruiz, 18, of Marshall appeared in custody in Lyon County District Court Aug. 26 on criminal sexual charges. Ruiz sexually assaulted a victim, 12, in May, June and July in Marshall, the complaint alleges. The court found probable cause for the charges. A plea hearing was set for Sept. 30.
MARSHALL - Abel Dejaun Chaparro Jr., 22, of Granite Falls appeared in Lyon County District Court Aug. 25 on charges of theft of a motor vehicle and possession of stolen property. Chaparro stole a car valued at $5,000 and drove it May 15 and 16 in Marshall, the complaint alleges. Bail with no conditions was set at $5,000 and at $1,000 with conditions of reappear in court, be of good behavior and others. A hearing was set for Sept. 2.
MARSHALL - William Ryan Arkrush, 30, of Marshall appeared in Lyon County District Court Aug. 25 on two counts of third degree driving while impaired. Arkrush drove while impaired on Aug. 24 in Lyon County, the complaint alleges. Bail was set at $12,000 with no conditions and $300 cash on the conditions he reappear in court, be of good behavior and others. A hearing was set for Sept. 8.
MARSHALL - Jose Rogelio Juarez, 29, of Marshall appeared in Lyon County District Court Aug. 25 on a charge of driving after cancelation-inimical to public safety. Juarez drove with a canceled driver's license on July 5 in Marshall, the complaint alleges. A public defender was to be appointed. Juarez was released on no bail on the conditions he obey all laws, reappear in court and others. A hearing was set for Sept. 8.
MARSHALL - Francisco Duran Ortega, 46, of Marshall appeared in Lyon County District Court Aug. 25 on two counts of second degree driving while impaired. Ortega drove while impaired with alcohol on Aug. 23 in Marshall, the complaint alleges. Bail was set at $12,000 with no conditions and at $300 with conditions of reappear in court, obey all laws and others. A hearing was set for Sept. 8.
MARSHALL - David Eugene Brush, 18, of Marshall appeared in Lyon County District Court Aug. 26 on a charge of financial transaction card fraud. Brush used a victim's debit card without consent and charged $472.98 in items April 7 to April 14 in Marshall, the complaint alleges. The court found probable cause for the charges. A plea hearing was set for Sept. 16.
MARSHALL - Gerald Wayne Teigland, 58, of Minneota pleaded innocent in Lyon County District Court Aug. 26 to two counts of second degree driving while impaired with the aggravating factor of prior DWIs in 2000 and 2001 and charges of equipment violation, open bottle and speed. Teigland drove with a blood alcohol concentration of .15, open beer in the vehicle, with improper illumination on his license plate and drove 65 in a 55 mph zone, the complaint alleges. A limine motion hearing was set for Oct. 24 and jury trial was set for Nov. 12.
MARSHALL - Bryce Bernard Doom, 24, of Marshall pleaded guilty in Lyon County District Court to a charge of third degree driving while impaired with the aggravating factor of prior DWI in 2004 and a charge of possession of drug paraphernalia. Doom drove with an alcohol concentration of .19 and had drug paraphernalia on June 14 in Lyon County, court records said. Doom was sentenced to one year in jail with a stay of execution of 320 days and placed on supervised probation up to two years. Doom must serve 45 days in jail, pay a $600 fine and follow other conditions. On the drug paraphernalia, Doom must pay a $50 fine.
MARSHALL - Tito Javier Briones Mendez Jr., 23, of Marshall used an Alford Plea and pleaded guilty to an amended charge of assault in the third degree. Under an Alford Plea, Mendez does not admit his guilt but says based on the evidence, a jury could find him guilty. Mendez hit a victim with a baseball on July 20, court records said. A pre-sentence investigation was ordered. A sentencing hearing was set for Sept. 16.
