Courts for June 10

MARSHALL — Brett Sovell, 29, of Marshall, appeared in Lyon County District Court May 30 on charges of refusal to take a chemical test, and fourth degree driving while impaired. A complaint alleges Sovell refused to take a chemical test in Marshall on April 28. A hearing was set for June 13.

MARSHALL — Micah Lee Ward, 23, of Waterloo, Iowa, pleaded not guilty in Lyon County District Court May 30 to two counts of fifth degree assault. A complaint alleges Ward assaulted a person in Marshall on March 17. Ward requested a speedy trial, but the court found probable cause to schedule a later trial date, court records said. A trial date was set for Sept. 14, and a pre-trial hearing was set for Sept. 5.

MARSHALL — Raymond Michael Alu, 36, of Marshall, pleaded guilty in Lyon County District Court May 30 to charges of domestic assault, court records said. Alu assaulted a person in Marshall on April 18, court records said. A sentencing hearing was set for June 27.

MARSHALL — Randy David Sershen, 60, of Minneota, was found guilty in Lyon County District Court June 1 of two counts of second degree driving while impaired charges, court records said. A criminal complaint alleged Sershen drove while impaired in Minneota on March 30, 2016. A jury found Sershen guilty of two counts of second degree driving while impaired, and not guilty of two additional counts of second degree driving while impaired charges, court records said. A sentencing hearing was set for July 17.

MARSHALL — Oscar Gutierrez-Barron, 36, of Brookings, appeared in Lyon County District Court June 5 on two counts of driving while impaired charges and charges of driving without a valid license. A complaint alleges Gutierrez-Barron drove while impaired in Lyon County on June 4. A hearing was set for June 20. Bail for Gutierrez-Barron was set at $12,000 without conditions, or $2,000 bond or $200 cash with conditions including appear in court, abide by laws, and abstain from alcohol and drugs.

MARSHALL — Dylan Lee Reynolds, 19, of Marshall, appeared in Lyon County District Court June 6 on charges of fifth degree controlled substance crime, possession of a stolen firearm, and possession of a small amount of marijuana. A complaint alleges Reynolds possessed drugs and a stolen firearm in Marshall on May 19. A hearing was set for June 20.

MARSHALL — Josh Paul Davis, 38, of Marshall, was sentenced in Lyon County District Court June 6 for charges of domestic assault. Davis assaulted a person in Lyon County on July 11, court records said. Davis received a stayed sentence of one year and one day in prison, a $500 fine and five years probation with conditions including serve 45 days in jail, and abstain from alcohol and drugs.

MARSHALL — Abdi Abdullahi Abdi, 27, of Marshall, was sentenced in Lyon County District Court June 6 for charges of fourth degree assault, second degree driving while impaired – refusal to test, third degree driving while impaired, obstructing legal process, and failure to provide proof of insurance. Abdi refused to take a chemical test in Marshall on Dec. 20, court records said. Abdi received a stay of imposition of sentence, and four years probation with conditions including serve 120 days in jail, with credit for 49 days already served, abstain from alcohol and drugs and complete 65 hours of community service work.

MARSHALL — Kyle James Oftedahl, 19, of Hanley Falls, appeared in Lyon County District Court June 6 on charges of fifth degree controlled substance crime and possession of drug paraphernalia. A complaint alleges Oftedahl possessed marijuana in Lyon County on April 13. A hearing was set for July 18.
